民间全民挺明福运动争取平反·赵家不满隐瞒恫言“跟随”纳吉

总检察署今早突然揭露被收藏长达一年的“关键文件”,令赵家大感不满,泪盈满眶地质问纳吉政府为何隐瞒证据,让家属至今被蒙在鼓里。

赵明福的妹妹丽兰是向代表律师哥宾星了解今日内庭详情后,声泪俱下向媒体作出控诉。

“今天给我看到我们司法不公正的一天,我想问首相有没有心要给我们家人一个真相,我想问首相是不是存心要隐瞒事实?”

“你要经过多少时间审判,要经过开棺验尸,要经过多少折磨,要经过不公平对待,一年后的今天没有结局,还跟我们说有新的证据,其实一年前已经在手上了,你们能接受吗?”

她也希望,首相能够听到他们的心声,履行一年之前许下彻查真相的承诺。

“如果首相太忙碌,无法记得他向我们许下的承诺,我们会跟随他到任何地方,以提醒他。”

考虑再次要求设立皇家委会

她表示,赵家正考虑再度要求政府设立皇家委员会彻查此事,并希望全国人民都能给予声援。

“我要人民的支持,我们可以站起来关注这个案件吗?这会影响你们的后代,你们的孩子。”

“我们或许会要求皇委会,我需要大家站起来支持我们的决定,如果我需要大家的时候,你们不要跟我泄气,跟我站起来,支持我们,我们要一个真相有这么困难吗?”

一批公民社会人士今午也在法庭外宣布发起“全民挺明福”运动(Malaysian for Beng Hock),以声援明福家属继续追求真相,同时也向政府施加压力。

这批热心人士主要是来自隆雪华堂民权委员会,他们包括庄国雄、廖国华、黄进发、黄业华,以及人权律师哈里斯依布拉欣等人。

“一日不平反,人人是明福”

“全民挺明福”运动协调员庄国雄(右图)表示,他们发起这项运动,主要是响应赵丽兰在一周年祭中号召,马来西亚人站来给予家人更多的支持。

“我们相信,在一个民主社会里,人人心中都有社会公义的火苗。只有不断勇于站出来平反冤假错案,为体制的被压迫者赎回公道,社会良心才得以保全,集体正义才得以伸张。”

“我们呼吁全国社团与公民抱着‘一日不平反,人人是明福’的信念,参与我们的运动,力挺明福,直到真相大白,酷刑永被废除。”

他们接下来将通过网站malaysiansforbenghock.wordpress.com或面子书发出声援活动,同时也会召开扩大会议,以争取更多个人和团体参与这个运动。

针对这批公民社会人士的声援,赵丽兰代表赵家表示感谢,并认为这将鼓舞他们继续坚持为明福追讨真相。

不需泪水怜惜只要真相大白

她较后发表声明也谴责反贪会采取各种方式来拖延验尸庭审讯,以及诬蔑其哥哥和家人的名声。

她强调,其哥哥是第一个死于中央政府机构的州政府官员,同时此案也并非是自杀案,相反是谋杀案。

“虽然我们不知道哥哥连续遭受11小时盘问是否确实,但这肯定是一个精神虐待,我们不敢猜测哥哥是否还面对其他虐待。”

“因为反贪会,我哥哥才会死亡;因为反贪会,其妻子才会失去丈夫;因为反贪会,我父母才会失去孩子;因为反贪会,我和哥哥、姐姐才会失去一个亲人;因为反贪会,我们的家庭才会失去快乐。”

她表示,赵家并不需要任何泪水的怜惜,相反是希望外界能够协助他们追查真相。

她也希望,大马不会再会有人遭警方、反贪会等执法机构虐死,其他警察暴力案的死者包括阿米奴拉昔都会获得伸张正义。

Teoh's family to 'follow PM' until truth is out

More than a year after his sudden death, the family of DAP political aide Teoh Beng Hock is bent on holding Prime Minister Najib Abdul Razak to his promise that the truth will be revealed.

"If he is too busy to remember his promise to our family, then we will follow him wherever he goes and remind him. My brother cannot die from torture just like that. He cannot," Teoh's sister Lee Lan said in between sobs.

Lee Lan was speaking at the launch of the 'Malaysians for Beng Hock' support group at the Shah Alam court complex today. She was accompanied by her parents who also shed tears while clutching Teoh's portrait.

Najib had last year vowed to the family that the government would not spare any effort in uncovering the truth behind the death of Teoh, 30.

His body was found on July 16, on the fifth floor service corridor of Plaza Masalam in Shah Alam.

He had been interrogated overnight as a witness by the Selangor Malaysian Anti-Corruption Commission (MACC), which has its office on the 14th floor of the building.

'No' to torture

The continuation of the inquest into his death stalled this morning, when it was found that the attorney-general's chambers has been withholding a document from lawyers representing the family and the Selangor government.

"We are disappointed with the MACC's delay tactics during the inquest and the way they have smeared my brother's and our family's good name," said Lee Lan.

She said that what the family is fighting for goes beyond her brother's death, following 11 hours of questioning which she described as "mental torture".

"I do not dare imagine what other sorts of torture he went through. Let us work towards a Malaysia that is free from torture. No one should be tortured and killed, be it in the MACC office, police lock-up, jail or detention camp," she said.

The 'Malaysians for Beng Hock' is an online support group that is lobbying for a torture-free Malaysia.

According to initiator Chong Kok Siong, the group will rally the masses in continuing to pressure the government over Teoh's case.

Royal commission not ruled out

Meanwhile, speaking to reporters after a 45-minute meeting with the family, Ipoh Timor MP Lim Kit Siang said the new development raises doubts about the Attorney General's seriousness in seeking the truth behind the death.

When asked if he is advocating for a Royal Commission of Inquiry to be set up, Lim said, "The option is always there...Whatever reservations we have (about the inquest), we hope the truth will come out."

Lim added that he has not seen the new evidence and as such is in no position to comment on its veracity, nor to confirm if it is indeed Teoh's 'final testament' as speculated.

Teoh's family members also kept mum when asked if they doubted the authenticity of the document, asking reporters to instead pose the question to the attorney general.

Asked if she had seen the document, Lee Lan said: "(Our lawyer) told us whatever we need to know".

Lawyer marches out of chambers over new evidence

Mystery marked the resumption of the inquest into the death of Teoh Beng Hock this morning, as lawyers first met coroner Azmil Mustapha Abas in chambers.

The meeting was to sort out matters related to a document.

However, 15 minutes later, lawyer Gobind Singh Deo left the building looking agitated.

It was later learnt that that the Attorney-General's Chambers had informed the coroner that a note found 18
months ago in Teoh's bag that "may throw some light regarding his death".

The contents of the said note, which was found two months after Teoh's death, is not known.

When asked, Gobind initially refused to reveal details of the discussion, except for saying: “This is abuse of the court process... Something happened. I am not impressed. I'm not saying any more .... Give me some time to speak to the family."

He then went across the court compound to talk to members of Teoh's family, who he represents.

Meanwhile, a supporter, holding up a photo of Teoh, yelled "Bunuh!"

He maintained his position, refusing to make way for cars in the court compound. He appeared to be trembling.

Identified previously by the Chinese media as Ho Mun Chong, he is said to have joined DAP after Teoh's death.

Since then, he has attended almost every event connected with Teoh's death, including the inquest.

He comes dressed in a red shirt and wears a band around his forehead.

Ho says very little, but trails Teoh's family-members, raising a clenched fist and holding a photo of Teoh.

'Documents withheld'

At 11.45am, the other lawyers emerged from the coroner's chambers. They too would not reveal what had taken place.

Speaking to reporters after consulting with the family, Gobind said he was informed this morning about a document that the prosecution had withheld.

"I was informed this morning that the prosecution will call the investigating officers to produce the document.

"When I asked which document, they told me (it had) not (been) given to us as there were orders. That's why I asked for an audience in chambers."

Asked if the document is Teoh's 'final testament' - the existence of which has been claimed by various parties including Senator Ezam Mohd Nor - the lawyer replied: "I am unable to say."

However, Gobind said the document, which reveals "significant" matters, had been in the prosecution's possession since last October.

"First of all, we don't know if this is authentic. Secondly, I wouldn't say it is detrimental.

"But it reflects that facts and circumstances material to the inquest should have been given to us so we could probe the (Malaysian Anti-Corruption Agency, MACC) witnesses further."

As such, he said, the next step to consider is to open a royal commission of inquiry into Teoh's death and the manner in which the inquest has been conducted.

Gobind said the prosecution did not explain why it held back the document, and claimed there is reason to believe that further evidence is being withheld.

Addressing the press in tears, Teoh's sister Lee Lan decried the "unjust" way in which the inquest has been handled.

"The judiciary has died," she said, holding back sobs.

Malik Imtiaz Sarwar, representing the Selangor government, said that while the evidence has not been tendered in court, the coroner had allowed lawyers to view the document.

"We may have approached the examination (better) if the document was given earlier...Are we now in a position to ask for re-examination of evidence?" he asked.

He said that, otherwise, "the inquest may not uncover the truth we all seek".

Both lawyers feel that the incident has undermined the integrity of the court and has raised questions about the attorney-general's credibility.

Inquest postponed

The inquest has now been postponed to Aug 18. The coroner has further decided not to call two witnesses who were due to have testified today.

The two, Lee Wye Weng and Mohd Harun Abdullah,had been interrogated by the MACC the same evening that Teoh had been questioned.

However, the coroner was said to have decided "there is no need" to call them as witnesses.

This means that Thai pathologist Dr Pornthip Rojanasunand will take the stand when the proceedings resume.

Teoh’s family wants PM to issue guarantees

Teoh Beng Hock’s family today urged Prime Minister Najib Razak to give Thai pathologist Dr Pornthip Rojanasunand the necessary guarantees to enable her to testify in the inquest which is probing the cause of death of the political aide.

At a press conference at the Parliament lobby today, Beng Hock’s sister Lee Lan read a prepared statement on behalf the family, expressing their sadness over news that Pornthip would not be testifying.

“We don’t want the inquest to end with a question mark,” she said.

Lee Lan added that Pornthip’s presence at the inquest was vital because the prominent Thai pathologist was their best hope in unearthing the truth behind Beng Hock’s death.

“We hope that Pornthip can help us to find out the truth. But all of a sudden… she was not able to come to testify. Everything is now back to square one. How can we not be disappointed?”

Lee Lan said that if the case remains unsolved, it would be the family’s “greatest regret”.

She also reminded Najib that he had once said “no stone will be left unturned in finding out the real cause of death”.


Najib, at a meeting with members of Teoh’s family in July last year, also vowed that action would be taken should there be foul play.

Lee Lan said that the prime minister should provide Pornthip the following:

1) An official guarantee from the government and the attorney-general regarding her safety;

2) That she be allowed to perform her professional duty as an independent witness in the Teoh case; and

3) Her on-going investigations in southern Thailand, which require her to travel to Kelantan, will not be affected by her involvement in the inquest.

According to Lee Lan, Pornthip’s testimony, when the inquest resumes next Tuesday, will be “the best birthday present for Beng Hock.”

The inquest which is set to resume next week coincidentally falls on the same date as Teoh’s birthday, April 20.

‘Instantaneous action’

Ipoh Timur parliamentarian Lim Kit Siang, who was also at the press conference, demanded an immediate response from Najib.

“In this day and age of instantaneous communication, with a prime minister that is IT savvy – he has a blog, he has Twitter and Facebook – I hope that he will find out about this and respond instantly.”

Najib is currently overseas in the US and will only be back next week after a three-day visit to Japan.

He also questioned Home Minister Hishammudin Hussein’s “wobbling” response to the issue.

“He should stop wobbling and waffling. The home minister should give his unconditional and unequivocal guarantee of Pornthip’s safety. How difficult is that? If he cannot, let someone else be home minister.”

Hishammuddin had demanded Pornthip to furnish him with exact details of the alleged threats before he can guarantee her personal safety.

Kabinet putus nama Teoh pada anaknya

Keputusan sama ada akan membenarkan nama mendiang Teoh Beng Hock diletakkan sebagai bapa dalam surat beranak anaknya yang sedang dalam kandungan tunangnya, akan dibuat oleh Kabinet.

Pada masa ini, kerajaan masih mengkaji implikasi dari sudut perundangan sekiranya membenarkan nama Teoh diletakkan sebagai bapa dalam surat beranak anaknya, kata Ketua Setiausaha Kementerian Dalam Negeri Datuk Seri Mahmood Adam.

Beliau memberitahu Bernama pejabat peguam negara telah diarah untuk mengkaji perkara itu dan keputusannya akan diketahui tidak lama lagi.

Teoh, 30, setiausaha politik kepada exco kerajaan Selangor, Ean Yong Hian Wah, ditemui mati pada 16 Julai lalu di tingkat lima Plaza Masalam di Shah Alam, sehari sebelum beliau mendaftarkan perkahwinannya dengan Soh Cher Wai.

Sebelum ditemui mati, Teoh memberi keterangan sebagai saksi siasatan penyalahgunaan wang kerajaan negeri Selangor kepada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Selangor yang berpejabat di plaza itu.

Soh, 28, seorang guru di Semenyih, Selangor, kini hamil dua bulan, dan telah membuat permohonan untuk meletakkan nama Teoh dalam surat beranak anaknya.

"Kita terpaksa berhati-hati dan mengkaji kes ini secara mendalam kerana ia memberi implikasi yang besar kelak," kata Mahmood.

Apa jua hasilnya, keputusan akhir akan dibuat oleh kabinet, katanya.

Bernama dimaklumkan Jabatan Pendaftaran Negara (JPN) menerima banyak permohonan seumpama itu setiap tahun daripada wanita yang tidak berkahwin dan permohonan mereka ditolak kerana jabatan itu memerlukan sijil nikah sebagai bukti sebelum seseorang anak itu didaftarkan.

Sumber JPN berkata sekiranya nama bapa bayi diletakkan dalam surat beranak tanpa mengesahkan ibubapa bayi itu yang sebenar, ia akan menimbulkan komplikasi di kemudian hari terhadap kanak-kanak itu dan keluarganya terutama dalam pertikaian pembahagian harta.

Teoh tidak ambil dadah, alkohol

Seorang ahli kimia, Zaraiha Awang dari Jabatan Kimia memberi keterangan sebagai saksi ketujuh pada hari inkues kematian Teoh Beng Hock hari ini.

Dalam keterangannya, Zaraiha berkata, beliau menerima sampel kandungan perut, darah dan air kencing Teoh.

Hasil pemeriksaan ke atas sampel tersebut, katanya beliau mendapati tidak ada kesan alkohol atau dadah dalam sistem badan Teoh pada masa kematiannya.

Inkues pagi ini bermula jam 9.20 pagi di mana saksi - pengawal keselamatan di Plaza Masalam, Abd Rahman Rahim dipanggil memberi keterangan.

Sebelum itu, DPP Tan Hock Chuan menyoal Abdul Rahman mengenai buku pelawat yang tiada diisi sejak berbulan lalu. Abdul Rahman mengakui tidak mengemaskini buku itu setiap masa.

Enam saksi telah dipanggil memberi keterangan semalam. Mereka terdiri daripada pengawal keselamatan di bangunan Plaza Masalam, seorang juruteknik dan seorang anggota polis dari balai Shah Alam.

Inkues tersebut berlangsung di hadapan Koroner Azmil Muntapha Abas.

Manakala peguam Gobind Singh Deo merupakan peguam pemerhati bagi pihak keluarga Teoh.

Gobind menyoal Zaraiha sama ada beliau tahu sejarah kes kematian Teoh dan spekulasi yang Teoh 'ditolak'.

Tan mencelah dengan berkata soalan tersebut tidak relevan.

Gobind membalas dengan bertanya mengapa perkataan "ditolak" dan 'bunuh diri" tidak boleh digunakan.

"Bukankah ini inkuiri terhadap kematiannya," kata Gobind.


Beliau bertanya mengenai kemungkinan terdapatnya kandungan adrenalin yang tinggi jika seseorang itu hampir jatuh atu ditolak dari tempat yang tinggi dan Zaraiha menjawab 'ya'.

Sehubungan itu, Gobind bertanya kepada Zaraiha sama ada beliau melakukan ujian adrenalin dan Zaihara menjawab 'tidak'.

Gobinda bertanya adakah Zaraiha tidak melakukan ujian tersebut kerana pihak polis tidak memintanya berbuat demikian.

Zaraiha menjawab bahawa Adrenalin bukanlah satu jenis dadah biasa dan ia dihasilkan secara semula jadidalam badan.

Apabila ditanya oleh Gobind sama ada beliau akan menjalan ujian tersebut jika diminta oleh pihak polis, Zaraiha berkata, ujian toksikologi tidak termasuk ujian adrenalin.

Koroner Azmil Muntapha pula bertanya sama ada terdapat perbezaan jika si mati ditolak dan sama ia boleh dikesan dalam ujian toksikologi.

Zaraiha : "Saya tidak berpengalaman untuk menjawab soalan itu."

Azmil : "Adakah pengetahuan sama ada si mati ditolak atau tidak akan mempengaruhi ujian mengesan kehadiran dadah atau racun dalam badan mangsa?"

Zaraiha : "Tidak."

Dalam keterangannya, Zaraiha juga mengesahkan bahawa Teoh tidak mati kerana diracun, mabuk atau berada di bawah pengaruh dadah.

Zaraiha berkata demikian setelah menjalankan analisis mengesan dadah, alkohol dan racun dalam badan Teoh melalui empat sampel spesimen yang diserahkan kepadanya oleh pegawai penyiasat pada 21 Julai lepas.

Katanya ujian toksikologi dilakukan bagi mengesan sama ada terdapat kesan racun atau sebarang bahan berbahaya terhadap spesimen biologi termasuk manusia dan haiwan.

"Hasil analisis saya mendapati tiada unsur ethanol, alkohol dan dadah biasa dalam spesimen itu," katanya.

Dalam keterangannya Zaraiha berkata sampel kandungan perut yang diterimanya berwarna kecoklatan yang merupakan warna biasa bagi kandungan perut manusia yang tidak mengandungi sebarang unsur dadah atau racun.

"Kandungan perut boleh berubah warna jika mengandungi unsur dadah atau racun, contohnya warna kelabu, jika terminum racun perosak," katanya.

Sementara itu, Bernama melaporkan Gobind bertanya kepada Zaraiha sama ada beliau ada pertimbangkan sejarah kes tersebut.

Zaraiha: "Dari borang polis yang diterima, saya dapati kes ini ialah kes jatuh dari bangunan tinggi. Saya ada tanya pada inspektor, diberitahu kes itu melibatkan setiausaha politik. Itu sahaja."

Gobind: "Ada baca surat khabar? Adakah kamu sedar sangkaan masyarakat dia ditolak dari bangunan tinggi?"

Peguam Tan Hock Chuan, yang dilantik oleh kerajaan untuk membantu mengendalikan prosiding itu, bangun mencelah untuk membantah penggunaan perkataan 'ditolak' itu.

"Kita tidak tahu sama ada Teoh telah ditolak. Ini adalah pandangan sebelah pihak. Tujuan inkues ini diadakan adalah untuk mencari kebenaran. Saya tidak ada masalah sekiranya kamu mengajukan soalan ini kepada pegawai SPRM tetapi saksi ini adalah ahli kimia, tolong berlaku adil kepadanya.

"Jangan bersandiwara di sini, tolong bataskan soalan anda berdasarkan peraturan."

Gobind : "Tuan koroner kami di sini untuk mencari kebenaran. Adakah tuan bermaksud saya tidak boleh mencadangkan teori saya, iaitu saya tidak boleh kata ditolak, jatuh. Bagaimana kita hendak meneruskan prosiding jika keadaan berterusan begini?"

Koroner kemudian segera menghentikan pertikaman lidah antara dua peguam itu dan mengingatkan semua pihak supaya mengajukan soalan yang relevan dan berkaitan dengan bidang tugas saksi sahaja.

Gobind kemudian mengemukakan soalan terakhir kepada Zaraiha sama ada ahli kimia boleh membantu ahli patologi untuk menentukan masa kematian Teoh.

"Kalau dilihat secara fizikal keadaan mayat mungkin tidak boleh, tetapi jika spesimen diuji dan jika ada unsur dadah, kita boleh bantu memberitahu masa kematian," kata Zaraiha.

Teoh, 30, setiausaha politik kepada Pengerusi Jawatankuasa Tetap Kampung Baru dan Pengurusan Kilang Haram Selangor, Ean Yong Hian Wah, ditemui mati pada 16 Julai lalu di tingkat lima Plaza Masalam di Shah Alam, selepas memberi keterangan sebagai saksi siasatan penyalahgunaan wang kerajaan negeri Selangor kepada SPRM Selangor yang berpejabat di bangunan itu.

Last officer to see Teoh alive left at 6.10am

There were 10 Malaysian Anti-Corruption Commission (MACC) officers in the Selangor headquarters between 8pm on July 15 and 8am on July 16, the day political aide Teoh Beng Hock died.

The MACC officers included an unnamed assistant director for the state who was seen leaving the building between 4am and 8am on July 16.

Apart from the senior person, the others were believed to be two or three officers who interrogated Teoh and one recording officer.

There was also an officer in a black casual shirt, believed to be the last person to have seen Teoh alive, who left at 6.10am.

These details were revealed at Teoh's inquest this afternoon by two night security guards at Plaza Masalam where the Selangor MACC is located.

Teoh, who was summoned to the MACC office for questioning on July 15, was found dead the next day outside the building. He is believed to have fallen from the 14th floor of the building where he was questioned.

The two security guards - Wan Rosli Wan Adam (fifth witness) and Abdul Rahman Rahim (sixth witness) - identified the MACC officials from photographs taken from closed circuit television recordings from Plaza Masalam lobby counter between midnight and 8am on July 16.

They were responding to questions from lawyer Tan Hock Chuan (left), who is leading a team of prosecutors from the Attorney-General's Chambers that includes DPP Mohd Abazafree Mohd Abbas.

In one recording which was shown to Wan Rosli, Teoh was seen walking in the lobby between midnight and 4am.

Another picture was also identified by Wan Rosli as being taken during his watch and showed four MACC officers accompanying a Chinese man (not Teoh) going into the building at about 12.52am.

The line of questioning of the two guards did not mention at what time Teoh was brought into the building for questioning. Previous media reports however stated that he was interrogated for 10 hours, arriving at MACC some time during the night of July 15.

Witness: No recording of ins and outs

Wan Rosli also said that he did not record particulars of any visitors to the building during his night watch.

He said that although there was a visitors' log-book at the lobby, the MACC officers were not required to fill in particulars whenever they brought in someone.

He was responding to a question from lawyer Gobind Singh Deo, representing Teoh's family.

Gobind: When you see the visitors entering or leaving the building at such odd hours, did you not take their particulars? Their purpose of the visit? And where they are heading to?

Wan Rosli: No, I agree I did not take down their particulars (photo:left).

Gobind: How regular in a week is it that the MACC officers would go in and out of Plaza Masalam office (at such late hours)?

Wan Rosli: Once or twice a week.

Gobind: Isn't this odd that MACC is working at these hours?

Wan Rosli: I know they operate for 24 hours.

Gobind: Can you state how many outsiders were brought in by MACC officers that night?

Wan Rosli: I do not know.

Gobind: Besides MACC officers, who came in late that night?

Wan Rosli: There were three officers from KDN (the Home Ministry), sometime after midnight but they occupy another floor.

Gobind: Did your security firm conduct an internal investigation after the incident?

Wan Rosli: No

Coroner wants the visitors' log book

Meanwhile, Abdul Rahman told the inquest that he manned the lobby counter between 4am and 8am and saw some of the MACC officers leaving the building.

Among them were the MACC assistant director as well as the last officer said to have seen Teoh alive. The latter had left at 6.10am.

Coroner Azmil Muntapha Abas at the conclusion of today's inquest instructed Abdul Rahman to bring the visitors' log-book tomorrow.

Earlier, Azmil asked the investigating officer as to who was in possession of the log-book and was told the police did not have it.

Tomorrow the inquest will hear testimony from pathologists and chemists and on Friday the inquest will visit the scene of the incident.

Besides Gobind, senior lawyers Karpal Singh and Sankara Nair are also acting for the family.

Lawyers Malik Imtiaz Sarwar and Sreekant Pillai represented the Selangor government while lawyers Cheow Wee and Richard Wee appeared for the Bar Council, which is holding a watching brief.

The inquest, originally planned to end on Aug 12, looks set to be extended beyond that with about 90 witnesses to take the stand.

Teoh, 30, was found dead on July 16 outside Plaza Masalam in Shah Alam, following interrogation for 10 hours by the MACC.

Ex-ACA top gun: Stop showering criticism on MACC

A former top ACA official has called for a stop to all speculation and unsavoury remarks against the Malaysian Anti-Corruption Commission (MACC), and to wait for the outcome of Royal Commission of Inquiry into the death political aide Teoh Beng Hock.

The call was sounded by the former Anti-Corruption Agency (ACA) director on investigations Abdul Razak Idris (right) who said, "MACC is now pre-judged and this is not right. We have to wait for the inquest as it involves sudden death. Moreover, it will be a special inquest because of the publicity and sensitivity of this case.

"We do not know what had happened out there. People talk out of frustration, speculation, sentiments, political spite and anger.”

He advised the public not to indulge in negative speculation, instead allow the inquest run its course.

“If an officer is guilty, let him be charged. If MACC is at fault, let the natural course of justice prevail. If the rules and regulations are not right, then the royal commission will recommend the right course of action," he said.

He maintained that the MACC has always been neutral, working without 'fear or favour'.

Abdul Razak maintained that the officers are trained to be neutral.

“You cannot just work for the ruling party. It would affect your conscience. ACA and the present MACC have never been biased,” he said.


Bigwigs not spared

Whether people know or not, all mentris besar, irrespective of being in the opposition or with the ruling party have been subjected to probes by these anti-corruption bodies, he said.

“We have even investigated prime ministers.” He added that leaders must realise that once in power the public's eye will be on them.

Those days, he added, they had to amass 90 percent of the evidence before a person could be charged.

He said Section 30 of the MACC 2009 Act bestows very wide powers on the investigating officer to call up witnesses at anytime. However, he said that there are also guidelines for the accused and rules for lockups.

"If they assault a witness, they can be punished under the Penal Code. However, as far as witnesses are concerned, we can interview them anytime of the day and night.

Abdul Razak said that the term “day to day” as stated in Section 30 (3)(a) of the MACC 2009 Act does not mean "daytime" but "running from day to day".

MACC accommodating body


"If the complainant lodges the report at night, then should we not record his statement at that time itself?

Abdul Razak said that although the officers do not go out of the normal norms and procedures or go against human rights, they are allowed to conduct interviews after office hours or at night.

"If the witness is only free in the evenings or nights, then we can accommodate him at night. It all depends on various circumstances. There cannot be any hard and fast rule," he said.

There's no set time limit for interviews as every investigator will have his own style of doing his work. So fixing time limits will not be effective.

"He manages his own investigation. The Act provides that we can interview anytime. Investigators are supposed to work 24 hours.

"Investigators are also humans. During my heydays, we used to sleep in the office and sometimes with the witnesses, complainants or even the accused. Those days we did not have lock-ups. So we arrested and investigated there and then," he said.

He said people tend to mistake interviews for interrogations but the objective remains the same, which is to get the truth and evidence from the witness.

Officers do not upset witnesses by making racial slurs as this could defeat the purpose of digging out the truth.

"If you make a person angry, you will not get the truth. In any interview or interrogation, there is a way to make people talk and tell the truth without resorting to physical force or abuse," he said.

Abdul Razak began his ACA career in 1974 and retired in 2004.

Facebook poll on Teoh's death

Malaysiakini has launched a Facebook poll to gauge public sentiments on the government proposed royal commission set up to probe the death of political aide Teoh Beng Hock.

The poll, which commenced on July 28, has so far drawn nearly 400 voters as of 2pm today.

An overwhelming majority felt that the commission's terms of reference should be expanded in order to get to the bottom of the mysterious circumstances surrounding the death.

A link to the poll was sent to all Malaysiakini Facebook group members, but other Facebook users could also vote.

Respondents were asked for their opinion on the investigation. They were allowed to either express satisfaction with the government's proposed inquest and royal commission; propose that the royal commission's terms of reference be expanded to cover the cause(s) of Teoh's death; state that the inquest and royal commission are not necessary and that the police can handle the case by themselves; or choose a blank option ("Others") and state their suggestions in the poll's comment section.

So what do those who voted for "Others" want to say?

Respondent Ivy Mok said, "It doesn't really matter who is going to investigate this. The result will be what the wise men want and may not be the truth."

Another participant, Boon Jin Tek, is in agreement, "If we look at this logically, if the notion is that the BN government is using MACC (Malaysian Anti-Corruption Commission) to attack PKR, would a royal commission or any inquest by the same people yield any positive results?

"I wonder if it is possible for a neutral party, i e some investigative institution from the Commonwealth or the UN (to investigate Teoh's death)."

Teoh died on July 16 after he was grilled by MACC Selangor officers into the wee hours of the morning.

He is said to have plunged to his death from the 14th floor-MACC Selangor office in Plaza Masalam.

He was questioned over the corruption allegations against his boss and Selangor exco Ean Yong Hian Wah.

ACA never used force, says former director

Teoh Beng Hock's death has raised the question as to whether the Malaysia Anti-Corruption Commission (MACC) uses force to extract information from witnesses.

A former Anti-Corruption Agency (ACA) senior officer has claimed that the corruption watchdog used to be a "civil and gentleman's organisation" that has never been accused of abusing or assaulting witnesses or suspects.

"We don't work like the police. We don't resort to using force to extract a confession. But I don't know (what it is like) now," said Mohamad Ramli Manan in an email interview with Malaysiakini on issues raised by Teoh's death.

"If you are a good investigator, you don't need a confession at all. You prove your case from other evidence."

The ACA was upgraded to the Malaysian Anti-Corruption Commission (MACC) in January.

Ramli (left) had stunned the nation in early 2007 when he alleged that then ACA director-general Zulkipli Mat Noor was involved in corruption and a sex offence.

Ramli had served as ACA deputy chief in three states - Kedah, Perak, Negeri Sembilan - before being appointed to head the agency in Kelantan, Malacca, Johor and Sabah.

Zulkipli was cleared by Attorney-General Chambers but his contract was not extended when it expired in March 2007.

Ramli said the ACA, created in 1967, had never resorted to handcuffing suspects or arrested persons. Unlike the police who deal with hardcore criminals, the anti-graft agency deals with white collar crimes where there is minimal risk of suspects escaping.

However, there was a departure from this practice early this year when two Perak Pakatan Rakyat state executive councillors were arrested.

"We were shocked to see that the exco members who had voluntarily surrendered to the MACC and other suspects were handcuffed for their remand proceedings.

"I would venture to say that the Perak exco suspects were handcuffed just to embarrass them. That speaks of the mentality of MACC officers compared to ACA officers."

Ramli, who retired in 2006, agreed that the ACA had always practised selective investigation.

"They are so afraid to investigate Umno ministers, excos and menteris besar unless they get the green light from the top. Officers who try to do so might find themselves facing trouble.

"MACC would not dare to do what they have done in Selangor and Perak in any of the BN states. They would not dare to handcuff an Umno exco member. That is a fact which nobody can deny."

'Cloak and dagger operation'

Although it has yet to be proven that the MACC used force when interrogating Teoh, Ramli noticed the investigation methods carried out on Selangor Pakatan assemblypersons were not in accordance with investigation procedures.

He revealed that the ACA investigations were divided into two stages and that this procedure is still in effect at the MACC.

An inquiry paper is opened upon receipt of any information. The investigations are conducted in a "cloak and dagger" manner at this stage.

"Nobody knows (this is in progress); not even the targeted suspects know that we are investigating the case since the purpose is to determine the truth or falsity of the information," said Ramli.

Only when the agency is convinced that the information is true, will a full scale investigation begin to secure all evidence to prove the alleged crime, he explained.

"In a full scale investigation, we are pretty sure that a corrupt offence had been committed. There is no such thing as a 'fishing expedition'.

"We know how many witnesses have to be called up and what evidence is available and obtainable from them; where and what documentary evidence we have to take and we also know where these documents are being kept."

Teoh's case handled against norm

According to Ramli, the Director of Operation may issue an 'Operation Order' detailing, mapping out and strategising the investigation if the case involves high-profile figures.

While he was heading the Sabah ACA, Ramli was Director of Operations in a case allegedly involving former Land and Cooperative Development Minister Kasitah Gaddam.

Ramli said such operations start in the morning and end about 7pm to 8pm. At this time, the officers will decide which suspects are to be further detained or whether the questioning should end.

"By 9pm the Director of Operations will call for a meeting to evaluate all the evidence that we have obtained and to give instructions for the next day's operations. This enables officers to get rest and prepare for the next day."

In Teoh's case, Ramli surmised from MACC director of investigation Mohd Shukri Abdul's statements that the Pakatan representatives were being investigated based on general information - or the first stage that requires discreet inquiry.

"What they did is against established practice and procedures of investigation methodology [...] I don't know the actual facts of the case," Ramli added.

"But if Shukri says they investigated based on general information received from anonymous sources or their informers, then an investigation through discreet inquiry is the proper investigative method."

PM meets Teoh's family, vows action

Prime Minister Najib Abdul Razak met with Teoh Beng Hock's family at his office in Putrajaya this evening at 7.30pm.

According to a Bernama report, the prime minister gave the family his assurance that all effort would be made to find out the cause of the political aide's death during the 30-minute meeting.

Beng Hock's father Teoh Leong Hwee, mother Teng Shuw Hor, elder brother Teoh Beng Kee, younger sister Teoh Lee Lan and fiancee Soh Cher Wei were present at the meeting which was held at the invitation of the premier.

Najib, after offering his sympathies and condolences to the family, told them that he and his cabinet viewed Teoh's death with grave concern.

"No stone will be left unturned in finding out the real cause of death and, if there is any foul play, action will definitely be taken," Najib told them.

Teoh, 30, was found dead on the fifth floor corridor of Plaza Masalam in Shah Alam on July 16 after being interviewed as a witness by the Malaysian Anti-Corruption Commission (MACC).

The commission is located on the 14th floor of the same building. Teoh was being questioned in connection with allegations that certain Selangor state assemblypersons had misused constituency funds.

Teoh was the political aide of Selangor exco member Ean Yong Hian Wah.

A solution for child's surname

At the meeting, Najib also explained to Teoh's family that the setting up of a royal commission of inquiry and the inquest constituted a two-pronged approach to find out the real cause of the unfortunate incident.

He said that the inquiry and inquest would find out whether any aspect as well as other measures taken (by MACC officers) could have been related to or led to the tragic incident.

Najib also said that he would ask the Attorney-General and relevant government departments to find a solution to a request from Soh to allow her unborn child to carry Teoh's surname.

Soh Cher Wei, 28, a school teacher from Semenyih, is two months' pregnant. Teoh was to have registered his marriage to Soh on July 17.

Also present at the meeting was Teoh's relative and former DAP secretary-general Kerk Kim Hock.

Aliran: A single body should investigate death

Aliran is very disappointed that the government had to appoint two bodies to inquire separately into Teoh Beng Hock's death when that matter could be - and should be - looked into by one single body.

The events leading to his death and the manner of questioning that led to his premature demise are inter-related and connected and it would be only sensible for the Royal Commission of Inquiry to have undertaken this entire task.

It can determine what caused his death and who contributed to this tragic episode and whether the long hours of questioning was a contributory factor.

The mystery surrounding Teoh's death must be vigorously and relentlessly pursued to unearth the truth - something that can only be achieved by the RCI.

Teoh's death has outraged the conscience of this nation. It is difficult to understand how his death could have taken place in a security area without the knowledge of MACC officials who had complete control over the premises.

His death has distressed us and has raised many questions of propriety in the manner he was treated by the investigating personnel(s). We must unravel the mystery that shrouds his death. But in no way can we reconcile to the possibility of a suicide.
Why would a young man about to marry the day after, a young man happily looking forward to becoming a father for the first time in about seven months' time would want to take his life!

Let's not forget that he had been on his feet the whole of Wednesday, 15 July 2009, when he was taken in at 5pm for questioning. This gruelling grilling continued into the wee hours of the next morning until 3.45am the next day - nearly 11 hours after he had gone into the MACC building.


Why should a friendly and co-operative witness - that's how a senior official of the MACC described Teoh - be subjected to this inhuman torture especially when as a witness he was there to assist the MACC?

Another witness, Tan Boon Wah, who was in the building at the same time as Teoh, had stated that he had to stand the whole time he was being questioned without food, sleep, rest or break. Beng Hock's session could not have been any different.

Anyone who had been subjected to this torture would have bolted from this hell hole when he was released at 3.45am. Why then didn't he leave the place in a jiffy?

Was it because the nearly 11 hours' of questioning had so drained him physically and emotionally that he was terribly exhausted and too weak to find his way home?

Is that why he plopped down there and then and slipped into a drowsy sleep?

What happened after that? When did he wake up? Who woke him up? Did anybody bother about his presence in that security area? Does it suggest that he was still confined within that building, thus holding the MACC responsible for his safety?

He was confined in an area with strict security measures. Nobody can come in and go out as one pleases. That being the case, shouldn't someone have checked on him to make sure that he left the building in good time?

To say that his body was discovered only at 1.30pm is ludicrous. He must have been in the building confined for nearly 10 hours. Is it reasonable even to think that nobody bothered about his continued presence in the building?

The MACC according to thinking Malaysians is a totally discredited entity that has failed to live up to the peoples' expectations. It is not perceived as an independent, neutral body doing its work without fear or favour.

Instead, it comes across as a body that seems to be hounding the Pakatan elected representatives only. People ask with justification why didn't the MACC act with vigour in pursuing reports made against Khir Toyo's palatial abode costing millions of ringgit?

People are questioning why Balkis was not investigated when they transferred millions of ringgit soon after Pakatan took over the Selangor government? People are wondering why the MACC didn't train their guns on the Barisan Nasional elected representatives who spent millions of ringgit within three months when the Selangor state government fell from the BN to the Pakatan?

Compare their indifference when millions of ringgit were involved implicating certain BN members. On the other hand, look how relentlessly they pursued a matter allegedly involving RM2,400!

These questions need answers. Only a RCI - headed by a person of impeccable integrity - undertaking the entire episode concerning Teoh's death can lay bare the facts of the case.

Former ACA official: Teoh held unlawfully

Standard procedures “were not followed” on July 15 by the Selangor Malaysian Anti-Corruption Commission (MACC), when it questioned DAP political aide Teoh Beng Hock at its office in Shah Alam.

Pointing this out when asked by Malaysiakini, a senior officer who retired from the Anti-Corruption Agency (ACA) in 2006, further alluded to malice on the part of the MACCin having exceeded its powers.

Mohamad Ramli Manan (left), in an email interview, said Teoh's interrogation was carried out beyond office hours and that this could be considered as “unlawful detention”.

The MACC had called in Teoh as part of its investigations into the alleged misuse of constituency development funds by several Selangor Pakatan Rakyat assemblypersons, including his boss and exco member Ean Yong Hian Wah.

“It is against established law and practice to interrogate them (suspects) in the night. The lock-up rules demand that they be sent to a lock-up by at least 8pm,” Ramli said.

“Witnesses are sent back to their offices or homes and asked to be present at another appointed date. I don't know why they had to call Teoh at 5pm. This may be due to poor planning or some evil intention or evil purpose on their part.”


Teoh was reportedly released by the MACC at 3.45am on July 16, but his body was found on the fifth floor balcony of Plaza Masalam about 1.30pm. The MACC occupies the 14th floor of the tower block overlooking the plaza.

During his service with the ACA, Ramli was deputy head in Kedah, Perak and Negri Sembilan, before being appointed to head the agency in Kelantan, Malacca, Johor and Sabah.

He shocked the nation in early 2007 when he alleged that then ACA director-general Zulkipli Mat Noor was involved in corruption and a sex offence.

Zulkipli was later cleared by the attorney-general's chambers, but his contract was not extended when it expired in March 2007.

Witness' consent required

Although the MACC was upgraded from the ACA early this year, Ramli said the investigation and interrogation procedures remain the same.

Under the ACA, interrogation used to begin as early as 8am and end between 7pm and 8pm.

“The rights of a witness are protected more than that of a suspect, who is under detention...the person can demand that the interview be adjourned to the next morning.

“The examining officer has to oblige, failing which this becomes an (unlawful) detention or arrest.”

He said the examining officer must also get the witness' consent to continue the interrogation beyond 8pm.

“Normally witnesses would consent to staying a bit longer until 9-10pm to have their statement recorded. But if they don't consent, there is nothing that the examining officer can do but to request that the interview be continued the next day. This is the law.”

Ramli cited media reports that Ean Yong (left) had turned up at the Selangor MACC, asking that Teoh be released. However, MACC officials claimed that they had 24 hours to question him.

“This shows that Teoh was definitely in the custody of the MACC. Under Section 15 of the Criminal Procedure Code, an arrest occurs when you confine the person (physically). Thus there was unlawful detention or arrest of Teoh.

“If there had been no detention, they should have allowed Teoh to go home at around 9pm or 10pm and requested him to come back the next day. He was definitely held against his will.”

After Teoh's death, the MACC said Teoh was merely a witness in the investigation, but did not state that he had been arrested or detained. It also claimed that Teoh wanted to rest for a while at the office after he had been allowed to go.

Preliminary police investigations have, however, found out that Teoh's mobile phone was still with the MACC at the time of his death.

Ramli said MACC should have issued an acknowledgment to Teoh upon his release, listing all the items they had taken from him.

“If no (such) list had been given to Teoh, it is difficult to say that he had been allowed to leave the office,” noted Ramli.

MACC has not confirmed if an acknowledgment list was given to Teoh.

An inquest to probe the circumstances surrounding Teoh's death is due to start tomorrow, and will continue to Aug 12.

Police report filed against 'Beng Hock' blog

Selangor executive councillor Ean Yong Hian Wah today lodged a police report against a blog that accused him of being involved in corruption and his colleague Ronnie Liu of siphoning off state funds in 2008.

Speaking to reporters before lodging the report at the Shah Alam police district headquarters, Ean said the blog "wanted to shift people's attention from the controversial death of his political aide Teoh Beng Hock."

The blog had accused Liu and Ean of having a hand in Teoh's death and that they were involved in corrupt practices, particularly with state funds meant for the MCA-held Sungai Pelek constituency.

"The blog also tried to implicate me in Teoh's death by accusing me and Liu of forcing him (Teoh) to collude in unlawful activities.

"These are all lies as Teoh never worked for Liu and he was never involved with the Sungai Pelek allocation affairs," he said.


Ean, who is also mulling filing a report with the Malaysian Communication and Multimedia Commission, also claimed that the blog was aimed at "disrupting unity among Pakatan Rakyat partners."

Liu, who initially did not agree to lodging a police report against the blog, said he agreed to it following the "advice he received from his DAP colleagues."

"I did not plan to lodge a police report because I don't believe in the police. I also stressed before that I would not report to the Malaysian Anti-Corruption Commission (MACC) either as I have lost faith in them.

"But my friends from DAP and the top Pakatan leadership said that I still need to lodge a report to avoid our enemies from manipulating the facts...and to show that I don't have anything to hide," said Liu, who has repeatedly denied the allegations.

Liu: I am an easy target

The blog titled 'Truth for Teoh Beng Hock' had posted documents to back its claim that 84 'projects' amounting to more than RM200,000 in the Sungai Pelek constituency were awarded to Liu's special assistant and Selayang councillor Wong Chuan How.

Sungai Pelek is a state seat held by Yap Ee Wah of the opposition Barisan Nasional.

Yesterday, Liu and Ean again reiterated that they have been defamed by the blog which alleged that the late Teoh had proof of the duo's corruption.

Teoh was found dead last week at the fifth floor landing of Plaza Masalam, Shah Alam, several hours after being questioned at the Selangor MACC on the 14th floor of the same building.

Today, Liu claimed that MACC will take action against him and Ean "although no report was lodged by anybody" over the allegations in the blog.

He also labelled himself as an "easy target for false allegations" as he is the state exco for local development.

Meanwhile, Shah Alam PAS parliamentarian Khalid Samad, who was also present, accused Umno and BN of trying to wreck Pakatan's unity in Selangor by targeting DAP.

"We all know that all the state fund expenditure has been posted on Liu's blog and this shows that the current state government now is more transparent," he said.

Utusan errs, but cops quiz Teoh's buddy instead

A minor mix-up of dates by Malay daily Utusan Malaysia resulted in a witness in the police probe on Teoh Beng Hock's death being recalled by the police for questioning.

Woo Chuan Seng, Teoh's best friend, told the press on Thursday that he last spoke to the deceased on July 15 - a day before his tragic death.

But unlike all other media, Utusan Malaysia had erroneously reported that the duo spoke on July 16 and for this, Woo received instructions late last night to appear before the Section 11 Shah Alam police station to clarify the dates.

Contacted today, Woo's legal counsel Lim Lip Eng let out a big sigh over the episode and chided the police for not contacting the Utusan's journalist instead.

“My client lives far away and by coming here, he has been inconvenienced a second time because of mistake by someone else,” said Lim, who is also Segambut MP.

“Where is the professionalism? Why are they so afraid to call up the Utusan reporter?” he added.

Lim, who accompanied Woo to the police station, said he had posed this question to the investigating officer, but was met with a wide smile as a reply.

All over in 15 minutes

According to Lim, the investigating officer said the police could not obtain clarification over the phone from Woo because he was required to sign certain documents.

The whole process today was over in about 15 minutes after an additional statement was recorded from Woo and after he showed the investigating officer - for the second time - a text message from Teoh on his phone.

On July 15, Teoh sent Woo a text message at 7.30am to ask him to be his best man at his wedding slated for Oct 3 and called him an hour later to enquire if the latter agreed.

Woo said he agreed to Teoh's request and the latter sounded very jovial.

Teoh, was to be have his civil mariage registered to two-month pregnant Soh Cher Wei, 28, on July 17.

Teoh was found dead on July 16 at the fifth floor landing of Plaza Masalam, Shah Alam several hours after being questioned at the Selangor Malaysian Anti-Corruption Commission on the 14th of the same building.

逾五千槟民齐声讨伐反贪委会,全场举手不信赵明福坠楼自杀

“赵明福坠楼命案”所激起的民愤持续延烧,自格拉纳再也体育馆的“莫让明福死不瞑目”大集会获得逾3千名群众出席后,昨晚聚集在槟岛爱心大厦礼堂的民众更已番倍突破5千人。

民联三党是于昨晚8时在爱心大厦,举办长达3小时的第二场“为明福声讨正义”团结集会。结果,出席的民众将大礼堂挤得水泄不通,不少人惟有站在礼堂外与大厦底层,借助大荧幕观看论坛的进行。

此外,除了台上高挂写有“莫让明福死不瞑目”的巨型布条,礼堂外也挂着相同字眼的4语布条。行动党工作人员则现场分派以“替明服讨回公道”为题的双语传单。

替赵子筹获万元教育基金

出席的重量级领袖包括槟州首席部长兼民主行动党秘书长林冠英、第一副首长曼梳、第二副首长拉玛沙米、回教党全国副主席玛夫兹、巴里文打区国会议员慕加希、公正党全国总秘书沙烈胡丁、槟州行动党主席曹观友、大山脚区国会议员章瑛及该党首位上议员东姑阿兹等。

出席集会的群众虽以华裔占绝大多数,但不乏巫印裔友族同胞。而轮流上台炮轰反贪委会的民联领袖则两度带领群众为赵明福肃立默哀1分钟,气氛沉重。

根据大会司仪宣布,当晚出席人数高达6千人,共筹获1万2900令吉,作为赵明福孩子的教育基金。

揶揄纳吉比阿都拉更不如

值得一提的是,台下群众频频配合致辞者发出应和声,更一度在民主行动党国会领袖林吉祥询问下,全场举手表示不相信赵明福坠楼自杀(上图)。

林吉祥承认,那是未经调查的观点,但反映出人民对警方毫无信任。

“我以为纳吉一回来就会宣布成立皇家调查委员会,难道其马华民政部长未传达诉求?许子根开始时态度显得模拟两可,但若无法代民提出要求,留在国阵的意义何在?”

接着,他借用阿都拉当年未通过内阁,宣布设立皇家委会处理“裸蹲案”的例子,嘲问纳吉是否比前者更不如。

“我们知道,警察在涉及政治的敏感案件上无法独立办事。如今,反贪污委员会和纳吉本身正被审判。”

宣布彭茂燊捐献5万令吉

东姑阿都阿兹一针见血地表示,赵明福的死亡证明我国未被妥当治理。他更疾呼,该机构是时候“滚蛋”了。

东姑阿都阿兹曾任国际透明组织大马分会主席,他对反贪会一直存有质疑。

他也指出,大马防范罪案基金执委彭茂燊也拥有相同的看法。

“身为防范贪污咨询委员会委员的彭茂燊在案发后,每隔两个小时就与我通电。他最后一通电话也表示,反贪会必须走人(must go)。”

东姑阿都阿兹说明,彭茂燊虽不愿透露接下来会采取什么步骤,但却托他告知民联领袖,愿捐献5万令吉予为赵明福遗腹子成立的基金会。

玛夫兹促开国会辩皇委会

另一方面,曹观友表示,民愤不断高涨,他甚至接获短讯要求褫夺反贪委会主席阿末赛益的“拿督斯里”勋衔。

玛夫兹则直呼,全国总警长慕沙哈山与阿末赛益在真相大白前闭嘴,同时国会应召开紧急会议,辩论皇家委员会的成员人选。

林冠英较早时建议,政府设立一个由该党上议员东姑阿都阿兹为首的皇家调查委员会,以彻查赵明福坠楼死亡案件。

质问警方仍未扣留调查官

压轴演说的林冠英怒斥,国阵领袖与数执法机构头子的言论“不是人”,当今政府的作风更非人民所求。

“在反贪会大厦内根本不能通行无阻,称未安装闭路电视则是一派胡言。何况,他隔日就要成亲。我看,纵使国阵领袖跳下去,他也不会跳。”

他认为,反贪委会指赵明福获释后不离开的说法,是侮辱大马人的智慧。他更质问,如果在谋杀案件上,最后一名接触死者的人士会最先被扣留,警方为何至今未逮捕盘问赵明福的调查官。

“看来,要恢复警队的威望,慕沙哈山应先丢官。而且,我们不该让一些丑角(joker)担任皇家调查委员会的成员。”

黄业华:悼明福

明福,你的死令人唏嘘。纳吉上任百日的时候,你还是雪州政府的职员,辛勤地为民服务;百日后你却离奇命丧雪州反贪委员会总部,使新首相的黑色成绩单上添一缕冤魂,实在叫人心酸。

纳吉喜欢与否,他的政绩将永远永远和你的名字纠缠在一起,就像含冤而死的蒙古女郎阿旦杜亚。是的,这是首相纳吉第二次和离奇命案扯上关系。

你我都知道,反贪委员会是首相署辖下的部门,由首相纳吉亲自领导。反贪委员会采取的任何行动,即使不是根据首相的命令行事,首相纳吉也没有反对。

因此,反贪委员会不调查价值125亿令吉的吧生港口自贸区丑闻,不调查前雪州大臣基尔估计价值2千4百万令吉的皇宫,不调查吉兰丹玛力勿莱补选中慕尤丁以大桥贿赂选民的言论,偏偏针对民联7议员的数千令吉选取拨款展开调查,首相纳吉对此也没有反对。

因此,反贪委员会把你——一个无关紧要的证人——传召到反贪委员会盘问,否决你接受法律咨询的权利,不允许你休息和用餐,连续10个小时直到凌晨3点45分的拷问,首相纳吉仍然没有反对。

上司必须为部下行为负责

善良的你也许会说,别苛责纳吉吧,他不可能知道部下所做的所有事情。

但是,一个上司可能不知道下属的标准作业流程(SOP),不可能不知道下属以违反人权的方式拷问充分给予合作的公民。以“人民第一,即刻表现”为口号的纳吉,必定了解执法单位如何行事,一旦有何差错必定马上介入纠正,也必定制定良好机制预防人民被执法单位虐待和迫害。

即使纳吉愚蠢至一无所知,难道他就不必为部下的行为负责吗?如此,政治问责的概念还有意义吗?

年轻的梦想被狠狠地敲碎

明福,你是一个准新郎,婚姻注册局的登记簿留空的栏位,等待见证你俩的海誓山盟和终生之约;家乡门前高挂的红布,挂满亲友的期待和夙愿;阿罗牙也的温暖阳光,等待一辆从巴株巴辖归来喜气洋洋的新郎车。

明年今日,你本该喜为人父,拥有一个美满幸福的家庭,永远不可能见到她泣不成声的样子。你或许已离开行政议员办公室,准备考取法律学位,继续从事为人民伸张正义的工作。

如今,这一切已成空。你的理想和对社会的热忱,被魔鬼狠狠地敲碎。

我知道你不甘心,不然你的尸身不会紧紧握着拳头。你的拳头透露了什么讯息?有意识下自杀的人何必握拳而死?没意识下被杀害的人岂能握拳而死?只有当一个人在有意识下被杀害,他才会通过最后的努力,发出死不瞑目的讯息。

你紧握的拳头代表了你的愤怒,是对这个残酷政权的呐喊和抗议。

然而,掌权者完全不在意你的不幸事件。当朝野政党、民间组织疾呼成立皇家调查委员会彻查你的死因,首相纳吉和副首相慕尤丁视如不见,依然坚持由警方调查。

执法部门过去有众多不良纪录

如果警察可以相信,何必成立独立调查委员会?如果反贪委员会可以相信,何必成立独立调查委员会?纳吉和慕尤丁当人民是白痴吗?

年龄相仿的你我,目睹了许多警察暴力和扣留所死亡事件。警察暴力驱散和平集会把人打得鲜血淋淋,政府至今没有对付一个涉嫌虐待古甘致死的警员,“警察是大马之王(Polis Raja Di Malaysia)”的观念早已深深烙进我们的脑海。

我们也阅读无数反贪委员会涉嫌滥权虐待嫌犯和无辜者的新闻。警察被反贪污局官员扣押,被强逼修改他所调查的案件的口供记录;巫统地方领袖被反贪局官员踢打虐待,被逼裸身滚在地上,以及威胁脱光他妻子的衣服。

和你同天被传召问话的加影市议员陈文华,指反贪委员会官员威胁他家人,恐吓要殴打他,用种族性语言斥骂他,要他站立四个小时不许坐下。又一次证实了反贪委员会官员滥权虐待证人的指控。

陈文华的经历令人震惊,而你,是否也经历了同样的过程?你是否拒绝屈服于淫威,而被进一步迫害?

执法队伍继续我行我素

在你出事后,我们完全感觉不到这两个机构的认真、负责任和意欲揭发真相的努力。在出了人命后,反贪委员会不但没有第一时间通知你的上司,没有说一句对不起,也没有斥责下属怠忽职守及停职查办涉及官员。

警方在还没有深入调查前,就把这个疑点重重的死亡案件归类为“猝死”,拒绝家属见尸体长达几个小时,只给予雪州政府一小时半的时间寻找独立法医。更令人难以置信的是,人民穿黑衣、点蜡烛、庆祝生日尚且被警方扣留三四天,警方对一宗涉及行政议员秘书的死亡事件,盘问17名反贪委员会官员后,竟然没有扣留调查一个人!

这是人民的政府吗?这到底是谁的政府?

国阵垮掉,你的冤屈将得平反

官官相护,双重标准,清清楚楚显示在他们的行动之中。警察部队和反贪委员会仿佛成了纳吉政府的“东厂”和“西厂”,专为迫害忠良而设。当一个政府为政治目的而不择手段草菅人命,这已不是民主的政治博弈,而是帝王的血腥暴政。

明福,直到看到你的照片,我才记得曾经和你有过几次简短的说话,每一次都是你先开口,我都没有问你的名字。在这种情况下得知你的名字,令我欲语无言。没有人会想到,你会成为阿旦杜亚第二,没有人会想到,你的名字会以这种方式和纳吉联接在一起。

经此惨剧,谁还愿意相信政府?谁还愿意配合反贪委员会的调查?不,我们永远都不会相信国阵政府,我们知道那蓝底白色的天秤永远无法平衡,我们知道只要国阵继续掌权,这种惨剧就会不断发生,每个大马人都可能成为下个受害者。

推翻暴政是实现民主的第一步,这是明福无法完成,付托给所有公民的巨大责任。我坚信,当国阵垮掉,你的冤屈将获得平反,正义终将到来。

我们为你默哀和祈祷,愿你的灵魂得以安息。

“莫让明福死不瞑目”大集会,3千人黑白衣出席默哀1分钟

为了表达赵明福离奇在反贪委会坠楼毙命的不满,民联在今午4点开始,假格拉纳再也体育馆举行抗议大集会。

7.15pm:大会宣告结束。巴生区国会议员查尔斯圣地亚哥助理黄业华为抗议《每日新闻》和《马来西亚前锋报》以种族主义的角度来解读赵明福事件,愤而在现场焚烧两报的报纸。

6.25pm:槟州首长林冠英抵达,而雪州大臣卡立也已人在现场。预计两人将随后发表演讲。

行动党国会领袖林吉祥、雪州议长邓章钦、回教党中委胡桑、行动党副主席东姑阿都阿兹和雪州行政议员西维尔等人都已分别上台致词。现场不断响起“还明福一个公道”的响亮口号。

5.25pm:人潮继续涌入,出席者已达到3000人之众。现场集会者群情汹涌,台上演讲的领袖也七情上脸,台下支持者频频发出震天的应和声。

5.00pm:现场出席人数达到2000人。行动党国会领袖林吉祥抵达。

此外,现场工作人员向出席者收集抗议签名,抗议信函中提出三项要求:设立皇家委员会调查赵明福死因、要求反贪委会主席阿末赛益下台,以及首相署部长纳兹里无条件道歉。

4.30pm:民众开始鱼贯进入体育馆,大约已有1000多人。出席者多数为华裔,他们也多身穿黑色或者白色衣服。在大会司仪的带领下,出席者也为赵明福默哀一分钟。

在观众席上,挂着一幅巨大的白底布条,上面中文写着“莫让明福 死不瞑目”,马来文“还明福公道,给人民交待”。

雪州行政议员欧阳捍华的政治秘书赵明福在本月15日下午被雪州反贪委员会传召问话,以调查雪州民联议员拨款是否有出现舞弊。

不过翌日下午,却惊传他在雪州反贪会总部坠离奇坠楼身亡的消息。反贪会全国调查主任苏克里随后证实,赵明福的尸体是于下午1点半,在沙亚南商业大厦5楼的阳台被人发现。

Preliminary results: Teoh died from high fall

Preliminary findings indicate deceased Teoh Beng Hock had no unexplained external injuries and died due to injuries from a high fall, police revealed today.

According to Bernama, Selangor police chief Khalid Abu Bakar said police have yet to rule out foul play in Teoh's death, but the case is still classified as a 'sudden death'.

"The initial report from the pathologist showed that Teoh didn't suffer any external injuries at the moment. However, we will wait for the full report from the pathologist concerned in a few days.

"For the time being, it was found that Teoh died from 'multiple injuries due to fall from a height," said Khalid.

An autopsy on Teoh was conducted yesterday at the Tengku Ampuan Rahimah Hospital in Klang by two pathologists.

Teoh, 30, was found dead on the fifth floor balcony of Plaza Masalam, Shah Alam on Thursday, after the Selangor Malaysian Anti-Corruption Commission (MACC) recorded his statements on the 14th floor of an adjacent building.

Khalid stressed that he was merely presenting initial findings and the case would be looked at from all possible angles.

17 MACC officers quizzed

He added that the police have taken statements from 23 witnesses, including 17 MACC officers.

There has been no arrests thus far.

According to Khalid, the police will also be interviewing Teoh's family, friends and colleagues.

He said the police were also reviewing CCTV footages of lifts and the carpark in the building.

The investigations into Teoh's death is being led by Selangor Commercial Crime Investigation Department chief Hasnan Hassan.

Nation shocked by death plunge

The food court was filling up in the late evening coolness of Cheras on Thursday. People from the tables around me were doing what I had just done, sauntering over to the newspapers vendor and picking up the evening edition of the next day's China Daily News.

They would return to the table and glanced at the front page, inevitably letting out a cry of shock, “Ean Yong Ian Wah's secretary died at MACC!” Everyone around the table would stare in disbelief, confusion, and anxiety. The newspaper was passed around the table. A whispered discussion then followed.

I imagined the scene repeating itself at dinner tables all around the country, with Malaysians sharing their silent explosion of outrage. Thinking about the ill-fated young man's parents, siblings and his grieving fiancée, I suddenly felt very sad and depressed.

Early the next morning, the rage and shock were boiling over on the Internet. On the blog 'Hornbill Unleashed', Pak Bui was associating the mysterious death of Teoh Beng Hock, 30, with that of A Kugan and Adi Anwar. Comments on many blogs expressed a universal condemnation of the MACC.

The first natural reaction would be: did Teoh commit suicide because he could not handle the heat of the intense investigation?

The possibility of suicide is nil. This young man was to have his marriage with his long-time girlfriend registered the next day. He was called in for questioning as a witness, and not as a suspect.

The alleged crime is too minor for any offender to contemplate suicide, even if he were to be charged. Besides, you can fault DAP leaders and members for many things, but you cannot fault them for cowardice.

How then did he fall to his death from the 14th floor? All kinds of theories flourish on the Internet. The most imaginative one has to be from controversial blogger Raja Petra Kamarudin. Prejudiced speculations will spread like wild fire in the days ahead throughout the country.

More questions than answers

The press conference given by the MACC investigation division director Shukri Abdull raised more questions than answers.

He said that Teoh was interrogated from 5pm to 3.45am. The deprivation of sleep during interrogation is a blatant form of torture, and should be banned by law. If long interrogation was necessary, why then did they not call him in at 9 in the morning and finish with it at around five in the afternoon?

Shukri said that Teoh was released at 3.45 in the morning, but preferred to rest on the couch in the MACC building till morning.

I had been detained for one night once, like many others. We all know that the minute we are released from detention, we wish we had wings to fly speedily to our loved ones. One more minute in the place where your personal liberty has been deprived seems like eternity in hell!

If Teoh had indeed decided to stay back and rest, surely he must have called his loved ones to assure them of his safety. Were there such calls made to his parents, his soon-to-be-wife, and his boss?

Teoh's lawyer M Manoharan had volunteered to accompany him for the duration of the interrogation, but this was denied by MACC. Under what law has the MACC the power to deny legal representation for witnesses being interrogated? If there is such a law, the law must be amended to remove such powers in the name of human rights and rule of law.

A life in full bloom cruelly cut short

So a young man at the prime of his life brimming with promise and prospect of personal happiness walked into the MACC building for an interview and ended up as a corpse. What other story can pluck at the heart-string of the national audience of our mainstream and alternative media than this tale of a life in full bloom cruelly cut short?

The MACC has the power to summon such witnesses in the discharge of their official duties, but they have every legal and moral responsibility to ensure the personal safety of every such witness. They cannot be exonerated from their legal liabilities in such a mysterious death. Will Teoh's parents take the MACC to court?

Tengku Razaleigh Hamzah – the widely respected grand old man of Malaysian politics – has this to say on his blog:

“With all Malaysians, I am shocked and deeply dismayed at the death of Teoh... The strange circumstances of Teoh's death put the credibility of the government and our investigative and law enforcement agencies under a microscope. The public will expect nothing less than a full investigation into how something like this could have happened.”

Indeed, the dismayed public of all races will expect nothing less than a full investigation into this mysterious death. Opposition Leader Anwar Ibrahim has already called for the establishment of a royal commission to probe into Teoh's death. The call is echoed by other opposition parties, civil society groups, bloggers, and even Khairy Jamaluddin, the Umno Youth chief.

There are the cynical among us who question such a call. Past royal commissions set up to investigate into police reform had been less than successful, because their findings and recommendations had not been accepted and implemented fully by the government.

That may be so. But democratic progress in any country is all about institution building. We ought to encourage the establishment of more royal commissions on controversial issues like Teoh's death.

In fact, the parameters of the proposed royal commission should include the probe of all deaths under detention, and the procedure of interrogation conducted by all law enforcement and investigative agencies.

As Razaleigh has surmised correctly, the sight of public outrage will be trained not only on the MACC and the Royal Malaysian Police, but eventually it will concentrate on the prime minister and his BN government. The call by the deputy prime minister for everybody to calm down would be seen as an arrogant insensitive retort against a spontaneous and universal outburst of grief among Malaysians.

First martyr under Najib's rule

Unpredictably and in one fell swoop, the death of the unfortunate young man at the MACC headquarters has turned the tide for the fracturing opposition coalition. The three component parties of the Pakatan Rakyat coalition have forgotten their public squabbles, and have stood united in seeking justice for Teoh.

This emotionally-charged tragedy has touched a raw nerve in the nation. Malaysians are not going to forget it anytime soon. The experienced political leaders in Pakatan are going to keep the memory of their first martyr under Najib's rule alive for months to come, with public rituals of mourning, remembrance, and requiem. It will turn out to be a hotter potato for Najib than the nation's economy and defeats at by-elections.

The momentum of BN from its near-win at the Manek Urai by-election, the rising popularity of the PM following the spin of his 100-day in office, and the announcement of his liberalisation measures will now be swept aside.

The continued repression of public gatherings in connection with Teoh's death will ensure that the fire of discontent will continue to be stoked to no end.

Eventually, it is all about the core value that must permeate any sovereign political entity: trust. The people must have trust in the laws of the land, and the institutions of state that are entrusted in the implementation of those laws.

When that trust vanishes because of abuse of power, then those institutions will not get the voluntary supportive cooperation from the people. Information from the sea of concerned honest civic conscious citizens will cease to come in, and the institutions will lose their moral legitimacy.

If the institutions still persist on exercising its power over the people after their moral legitimacy has already been destroyed by themselves, then it is warfare between those institutions and the people whom they are supposed to guard against injustices. That is a sure formula for chaos.

That is the fate awaiting the MACC at this critical juncture of our nation's history.
