民间全民挺明福运动争取平反·赵家不满隐瞒恫言“跟随”纳吉

总检察署今早突然揭露被收藏长达一年的“关键文件”,令赵家大感不满,泪盈满眶地质问纳吉政府为何隐瞒证据,让家属至今被蒙在鼓里。

赵明福的妹妹丽兰是向代表律师哥宾星了解今日内庭详情后,声泪俱下向媒体作出控诉。

“今天给我看到我们司法不公正的一天,我想问首相有没有心要给我们家人一个真相,我想问首相是不是存心要隐瞒事实?”

“你要经过多少时间审判,要经过开棺验尸,要经过多少折磨,要经过不公平对待,一年后的今天没有结局,还跟我们说有新的证据,其实一年前已经在手上了,你们能接受吗?”

她也希望,首相能够听到他们的心声,履行一年之前许下彻查真相的承诺。

“如果首相太忙碌,无法记得他向我们许下的承诺,我们会跟随他到任何地方,以提醒他。”

考虑再次要求设立皇家委会

她表示,赵家正考虑再度要求政府设立皇家委员会彻查此事,并希望全国人民都能给予声援。

“我要人民的支持,我们可以站起来关注这个案件吗?这会影响你们的后代,你们的孩子。”

“我们或许会要求皇委会,我需要大家站起来支持我们的决定,如果我需要大家的时候,你们不要跟我泄气,跟我站起来,支持我们,我们要一个真相有这么困难吗?”

一批公民社会人士今午也在法庭外宣布发起“全民挺明福”运动(Malaysian for Beng Hock),以声援明福家属继续追求真相,同时也向政府施加压力。

这批热心人士主要是来自隆雪华堂民权委员会,他们包括庄国雄、廖国华、黄进发、黄业华,以及人权律师哈里斯依布拉欣等人。

“一日不平反,人人是明福”

“全民挺明福”运动协调员庄国雄(右图)表示,他们发起这项运动,主要是响应赵丽兰在一周年祭中号召,马来西亚人站来给予家人更多的支持。

“我们相信,在一个民主社会里,人人心中都有社会公义的火苗。只有不断勇于站出来平反冤假错案,为体制的被压迫者赎回公道,社会良心才得以保全,集体正义才得以伸张。”

“我们呼吁全国社团与公民抱着‘一日不平反,人人是明福’的信念,参与我们的运动,力挺明福,直到真相大白,酷刑永被废除。”

他们接下来将通过网站malaysiansforbenghock.wordpress.com或面子书发出声援活动,同时也会召开扩大会议,以争取更多个人和团体参与这个运动。

针对这批公民社会人士的声援,赵丽兰代表赵家表示感谢,并认为这将鼓舞他们继续坚持为明福追讨真相。

不需泪水怜惜只要真相大白

她较后发表声明也谴责反贪会采取各种方式来拖延验尸庭审讯,以及诬蔑其哥哥和家人的名声。

她强调,其哥哥是第一个死于中央政府机构的州政府官员,同时此案也并非是自杀案,相反是谋杀案。

“虽然我们不知道哥哥连续遭受11小时盘问是否确实,但这肯定是一个精神虐待,我们不敢猜测哥哥是否还面对其他虐待。”

“因为反贪会,我哥哥才会死亡;因为反贪会,其妻子才会失去丈夫;因为反贪会,我父母才会失去孩子;因为反贪会,我和哥哥、姐姐才会失去一个亲人;因为反贪会,我们的家庭才会失去快乐。”

她表示,赵家并不需要任何泪水的怜惜,相反是希望外界能够协助他们追查真相。

她也希望,大马不会再会有人遭警方、反贪会等执法机构虐死,其他警察暴力案的死者包括阿米奴拉昔都会获得伸张正义。

Teoh's family to 'follow PM' until truth is out

More than a year after his sudden death, the family of DAP political aide Teoh Beng Hock is bent on holding Prime Minister Najib Abdul Razak to his promise that the truth will be revealed.

"If he is too busy to remember his promise to our family, then we will follow him wherever he goes and remind him. My brother cannot die from torture just like that. He cannot," Teoh's sister Lee Lan said in between sobs.

Lee Lan was speaking at the launch of the 'Malaysians for Beng Hock' support group at the Shah Alam court complex today. She was accompanied by her parents who also shed tears while clutching Teoh's portrait.

Najib had last year vowed to the family that the government would not spare any effort in uncovering the truth behind the death of Teoh, 30.

His body was found on July 16, on the fifth floor service corridor of Plaza Masalam in Shah Alam.

He had been interrogated overnight as a witness by the Selangor Malaysian Anti-Corruption Commission (MACC), which has its office on the 14th floor of the building.

'No' to torture

The continuation of the inquest into his death stalled this morning, when it was found that the attorney-general's chambers has been withholding a document from lawyers representing the family and the Selangor government.

"We are disappointed with the MACC's delay tactics during the inquest and the way they have smeared my brother's and our family's good name," said Lee Lan.

She said that what the family is fighting for goes beyond her brother's death, following 11 hours of questioning which she described as "mental torture".

"I do not dare imagine what other sorts of torture he went through. Let us work towards a Malaysia that is free from torture. No one should be tortured and killed, be it in the MACC office, police lock-up, jail or detention camp," she said.

The 'Malaysians for Beng Hock' is an online support group that is lobbying for a torture-free Malaysia.

According to initiator Chong Kok Siong, the group will rally the masses in continuing to pressure the government over Teoh's case.

Royal commission not ruled out

Meanwhile, speaking to reporters after a 45-minute meeting with the family, Ipoh Timor MP Lim Kit Siang said the new development raises doubts about the Attorney General's seriousness in seeking the truth behind the death.

When asked if he is advocating for a Royal Commission of Inquiry to be set up, Lim said, "The option is always there...Whatever reservations we have (about the inquest), we hope the truth will come out."

Lim added that he has not seen the new evidence and as such is in no position to comment on its veracity, nor to confirm if it is indeed Teoh's 'final testament' as speculated.

Teoh's family members also kept mum when asked if they doubted the authenticity of the document, asking reporters to instead pose the question to the attorney general.

Asked if she had seen the document, Lee Lan said: "(Our lawyer) told us whatever we need to know".

明福坠楼验尸庭‧“明福遗书”?总检署呈“收藏”逾年证据

(雪兰莪‧沙亚南)“赵明福验尸案”今日(週一,8月9日)出现新的发展,总检察署突然要求提呈一份被“收藏”了逾一年,以及据说对赵明福死因极为关键的新证据,犹如对本案投下一枚震撼的炸弹。

被蒙在鼓里一年之久的赵家在闻讯后,声泪俱下的提出抗议。

针对这份文件是否与某马来报章较早前所指的“赵明福遗书”有关,赵家代表律师哥宾星等皆三缄其口。

验尸庭原订週一传召承包商李维荣和哈伦出庭,但总检察署却在最后一分钟拋出有关的“新证据”。

赵家代表律师哥宾星在週一早上10时35份甫开庭时,即被要求进入內庭进行紧急商议,却在45分钟后怒气冲冲的收拾文件离开。

总检察署、大马反贪污委员会及雪州政府等3造代表律师,在哥宾星离开半小时后从內庭步出;在面对媒体追问时,各造律师皆不愿正面回答。

哥宾星较后对记者说,他於週一早上开庭前才获通知总检察署献议传召本案查案官阿末纳兹里出庭,以提呈新证据。

哥宾星:可改变案件本质

他透露,新证据在本案扮演著举足轻重的角色,若总检察署在审讯一开始即提呈,便足以改变整起案件的本质。

“首先,我们不知道证据的真偽,我也不会说新证据会对我们造成不利;我只能说,这项证据明显的反应了对验尸庭很关键的实据和情况。”

他强调,新证据对本案非常关键,因为它会影响各造律师在盘问证人或专家,特別是反贪委会官员时的方向和推论。

他说,总检察署承认早在去年10月就掌握这项证据,但他不解该署为何要等至普緹上庭前才选择公开新证据。

週一距离泰国法医普緹来马出庭供证已进入倒数的最后8天。

哥宾星披露,在过去约1年的聆讯期间,总检察署不曾提及有关新证据,却在聆讯接近尾声时,出其不意的给大家一个意外。

指设立皇委会才能厘清

他说:“我们非常认真看待这件事,並认为事情演变至今,唯有成立皇家调查委员会才能彻底厘清整起事件的始末。”
“我们不知道总检察署到底还有多少文件还未公开,这是一件非常严重的事情。”

他也向民眾保证,绝不允许案件“静悄悄”的进行,並表示会在適当的时候公佈一切详情。

Lawyer marches out of chambers over new evidence

Mystery marked the resumption of the inquest into the death of Teoh Beng Hock this morning, as lawyers first met coroner Azmil Mustapha Abas in chambers.

The meeting was to sort out matters related to a document.

However, 15 minutes later, lawyer Gobind Singh Deo left the building looking agitated.

It was later learnt that that the Attorney-General's Chambers had informed the coroner that a note found 18
months ago in Teoh's bag that "may throw some light regarding his death".

The contents of the said note, which was found two months after Teoh's death, is not known.

When asked, Gobind initially refused to reveal details of the discussion, except for saying: “This is abuse of the court process... Something happened. I am not impressed. I'm not saying any more .... Give me some time to speak to the family."

He then went across the court compound to talk to members of Teoh's family, who he represents.

Meanwhile, a supporter, holding up a photo of Teoh, yelled "Bunuh!"

He maintained his position, refusing to make way for cars in the court compound. He appeared to be trembling.

Identified previously by the Chinese media as Ho Mun Chong, he is said to have joined DAP after Teoh's death.

Since then, he has attended almost every event connected with Teoh's death, including the inquest.

He comes dressed in a red shirt and wears a band around his forehead.

Ho says very little, but trails Teoh's family-members, raising a clenched fist and holding a photo of Teoh.

'Documents withheld'

At 11.45am, the other lawyers emerged from the coroner's chambers. They too would not reveal what had taken place.

Speaking to reporters after consulting with the family, Gobind said he was informed this morning about a document that the prosecution had withheld.

"I was informed this morning that the prosecution will call the investigating officers to produce the document.

"When I asked which document, they told me (it had) not (been) given to us as there were orders. That's why I asked for an audience in chambers."

Asked if the document is Teoh's 'final testament' - the existence of which has been claimed by various parties including Senator Ezam Mohd Nor - the lawyer replied: "I am unable to say."

However, Gobind said the document, which reveals "significant" matters, had been in the prosecution's possession since last October.

"First of all, we don't know if this is authentic. Secondly, I wouldn't say it is detrimental.

"But it reflects that facts and circumstances material to the inquest should have been given to us so we could probe the (Malaysian Anti-Corruption Agency, MACC) witnesses further."

As such, he said, the next step to consider is to open a royal commission of inquiry into Teoh's death and the manner in which the inquest has been conducted.

Gobind said the prosecution did not explain why it held back the document, and claimed there is reason to believe that further evidence is being withheld.

Addressing the press in tears, Teoh's sister Lee Lan decried the "unjust" way in which the inquest has been handled.

"The judiciary has died," she said, holding back sobs.

Malik Imtiaz Sarwar, representing the Selangor government, said that while the evidence has not been tendered in court, the coroner had allowed lawyers to view the document.

"We may have approached the examination (better) if the document was given earlier...Are we now in a position to ask for re-examination of evidence?" he asked.

He said that, otherwise, "the inquest may not uncover the truth we all seek".

Both lawyers feel that the incident has undermined the integrity of the court and has raised questions about the attorney-general's credibility.

Inquest postponed

The inquest has now been postponed to Aug 18. The coroner has further decided not to call two witnesses who were due to have testified today.

The two, Lee Wye Weng and Mohd Harun Abdullah,had been interrogated by the MACC the same evening that Teoh had been questioned.

However, the coroner was said to have decided "there is no need" to call them as witnesses.

This means that Thai pathologist Dr Pornthip Rojanasunand will take the stand when the proceedings resume.

Teoh’s family wants PM to issue guarantees

Teoh Beng Hock’s family today urged Prime Minister Najib Razak to give Thai pathologist Dr Pornthip Rojanasunand the necessary guarantees to enable her to testify in the inquest which is probing the cause of death of the political aide.

At a press conference at the Parliament lobby today, Beng Hock’s sister Lee Lan read a prepared statement on behalf the family, expressing their sadness over news that Pornthip would not be testifying.

“We don’t want the inquest to end with a question mark,” she said.

Lee Lan added that Pornthip’s presence at the inquest was vital because the prominent Thai pathologist was their best hope in unearthing the truth behind Beng Hock’s death.

“We hope that Pornthip can help us to find out the truth. But all of a sudden… she was not able to come to testify. Everything is now back to square one. How can we not be disappointed?”

Lee Lan said that if the case remains unsolved, it would be the family’s “greatest regret”.

She also reminded Najib that he had once said “no stone will be left unturned in finding out the real cause of death”.


Najib, at a meeting with members of Teoh’s family in July last year, also vowed that action would be taken should there be foul play.

Lee Lan said that the prime minister should provide Pornthip the following:

1) An official guarantee from the government and the attorney-general regarding her safety;

2) That she be allowed to perform her professional duty as an independent witness in the Teoh case; and

3) Her on-going investigations in southern Thailand, which require her to travel to Kelantan, will not be affected by her involvement in the inquest.

According to Lee Lan, Pornthip’s testimony, when the inquest resumes next Tuesday, will be “the best birthday present for Beng Hock.”

The inquest which is set to resume next week coincidentally falls on the same date as Teoh’s birthday, April 20.

‘Instantaneous action’

Ipoh Timur parliamentarian Lim Kit Siang, who was also at the press conference, demanded an immediate response from Najib.

“In this day and age of instantaneous communication, with a prime minister that is IT savvy – he has a blog, he has Twitter and Facebook – I hope that he will find out about this and respond instantly.”

Najib is currently overseas in the US and will only be back next week after a three-day visit to Japan.

He also questioned Home Minister Hishammudin Hussein’s “wobbling” response to the issue.

“He should stop wobbling and waffling. The home minister should give his unconditional and unequivocal guarantee of Pornthip’s safety. How difficult is that? If he cannot, let someone else be home minister.”

Hishammuddin had demanded Pornthip to furnish him with exact details of the alleged threats before he can guarantee her personal safety.

明福儿子尔家满月·逾百亲友聚赵家献祝福

(马六甲)赵家今日(週六,3月20日)为明福遗腹子赵尔家提早举行弥月之喜庆祝会,逾百名亲友及社会人士到来祝贺,为小尔家及母亲苏淑慧送上真诚祝福。

精灵活泼的尔家並不怕生,躺在床上不时转动著眼睛,仿佛对陆续来探望他的人们感到好奇,而床头置放著赵明福的遗照。

在旁看护的苏淑慧看起来精神不错,不时露出笑容;她希望儿子过著平淡的生活,不要生活在社会压力下,因此故婉拒媒体拍摄儿子的样子。

赵家週六也准备丰盛菜肴祭拜祖先,祈愿赵家第一名內孙平安长大。

於2月22日出生的赵尔家,弥月正日是在3月24日,赵家为方便亲友探访,提早数天举办庆祝会。

苏淑慧家人、赵明福兄姐妹、阿姨、舅舅及朋友们都到来祝贺,马六甲行动党州议员邱培栋及林敬贤亦有出席。


隆尊孔独中组团探望

另外,吉隆坡尊孔独中特组成一支18人的探访队伍,送上一幅写满祝福的温馨“母子图”予淑慧,以及其他祝福卡片、图书及小礼物,同时也移交一笔5300令吉捐款予赵明福基金。

苏淑慧:完成学业之前
“不想孩子曝光成焦点”


苏淑慧表示,目前不想太多,把精神放在照顾孩子上,一切顺其自然,只希望自己和孩子不要成为眾人焦点,尤其是孩子。“希望孩子在完成学业之前都不要曝光,因为我们不希望孩子去到哪儿都被人认出来。”

询及日后是否將把明福事件告诉孩子,她说,“顺其自然吧!”对於孩子出生后的情况,她说一切还好,半夜会起来喂奶。

淑慧指出,她个人认为让孩子未来自由发展,並不会特別阻止他从政。

4月杪返校执教

在峇株巴辖执教的苏淑慧目前享有2个月產假,4月杪才返回学校执教。她表示,孩子由本身母亲照顾,往后將不时回马六甲,带尔家回去见公公婆婆。

她说,赵明福基金由张念群任信托人,每个月给予一笔费用,作为尔家的教育、生活及医药费用,而她生產住院费用,亦由基金支付。

赵妈妈悲喜交集


明福的妈妈张秀花虽然开心迎来赵家第一个內孙,但坦言永远无法忘记失去明福之痛。“有內孙是很开心的,但內孙没有了父亲,是很悲伤的事情。”

她说,失去明福的痛苦仍存在,尤其抱著尔家时,仿佛回到当年抱著明福的时光,让她觉得又开心又悲伤。赵妈妈希望尔家健康长大,乖巧听话,做个像明福一样孝顺的孩子。

询及孩子长相与谁相似,赵妈妈露出难得的笑容说:“小孩子的样子一直变的,不过还是像妈妈比较多。”她说,日后將会经常到峇株巴辖去探望孙子。

普緹供证恰逢明福生忌

泰国法医普緹將於4月20日上庭供证,当天凑巧是赵明福生忌,妹妹赵丽兰希望能在这天看到公道,正义获得伸张!

赵丽兰表示,希望当天能看到对赵明福案有帮助的线索,让案子能早日水落石出。“我们对普緹有信心!”

在今日的尔家弥月之喜盛会上,赵丽兰觉得心情復杂,脑海里也不时浮现哥哥的笑容,感慨万千。“如果哥哥还有在,他一定是最高兴的。

我还记得他一知道嫂嫂怀孕后,不断打电话来问妈妈如何照顾孕妇。”她说,家人会在清明节时,带著尔家去拜祭爸爸赵明福。

她表示,转眼间明福已过世9个月,但每一个佳节来临,都让家人更加思念。“不过,我们不会放弃寻找真相。”

“明福不曾被掐颈”‧政府法医反口

(雪兰莪‧沙亚南)没有武器、没有人证,双溪毛糯医院法医组主任沙希淡声称,赵明福身上所有伤势皆与坠楼吻合,推翻本身较早前指赵明福颈部瘀伤或被掐所致的供词。

他也声称,赵明福肛门的伤痕並非硬物插入或鸡姦所致,而是符合坠楼的伤势。他也指赵明福臀部的伤痕是坠楼后所致,並非被人鞭打。

伤痕裂痕瘀痕皆非人为

沙希淡今日(週三,3月10日)在庭上改口称,赵明福在坠楼前不曾被锁喉或掐颈,仅承认赵明福颈部的伤势在坠楼前已存在,但不是致命点。

负责为赵明福“开棺验尸”的沙希淡也是本案第31证人,他週三接受大马反贪委会代表律师拿督阿都拉萨盘问时重申,赵明福肛门处的伤痕、头颅所出现的裂痕和臀部瘀痕皆非人为。

他说,赵明福颈部的瘀伤显示该部位曾被施加“外来压力”,但碍於死者没有出现窒息跡象,所以颈部瘀伤並非为致死赵明福的主因。

沙希淡在3月1日接受赵家代表律师哥宾星和雪州政府代表律师马力英迪亚盘问时曾指出,他不排除赵明福颈部呈红色瘀伤是被人所掐,只是可能性很小。

不过,他週三在阿都拉萨盘问下,全盘否决这项可能性,並坚称赵明福生前不曾遭人掐颈或锁喉。

阿都拉萨在盘问结束前,向沙希淡拋出最后一道被视为总结的问题:“由於没有使用武器、硬物,更没有人证目睹赵明福如何跌下楼,你是否可证明赵明福身上所有的伤都是因从高楼坠下所致,他在坠楼前没有受伤?”

沙希淡回答说:“我认为,赵明福身上的伤痕皆符合坠楼的伤势,因为其身上的骨折和內伤都证明了这一点。”


肛门伤痕非硬物插入所致

另一方面,沙希淡声称,赵明福肛门的伤痕並非硬物插入或鸡姦所致,因为他发现赵明福的荐骨与肠骨在坠楼后断裂,较后又“回归原位”,以致肛门受伤;对他而言,这符合坠楼的伤痕。

“我並没有发现死者肛门有被硬物或其它武器插入的跡象。”

他也反驳泰国法医普緹较早前指赵明福头颅出现的裂痕或遭硬物攻击的说词,他说:“死者头颅右边的裂痕较严重,这也是死者臥尸在5楼时的最后姿势,符合坠楼的伤势。”

“若头颅上的伤势是在14楼发生,14楼会一片杂乱,况且,死者在坠楼时撞击地上;我认为,这足够造成死者的头颅破裂。”

第3度出庭
沙希淡供词前后不一


负责为赵明福开棺验尸的沙希淡被视为鉴定赵明福真正死因的关键人物,不过,已第3度出庭供证的他,在针对赵明福颈部为何出现瘀伤的供词互相矛盾、前后不一。

在今年2月19日首度出庭供证的沙希淡,曾3度否决著名泰国法医普緹指赵明福颈部被掐、肛门被插和大腿后侧被打的论据。

不过,他较后於3月1日接受哥宾星和马力英迪亚盘问时,却表明不排除赵明福被掐颈的可能性,惟这项供词在10天后,又被沙希淡本身推翻。

从多处伤势判断
明福坠楼时清醒


沙希淡强调,依据赵明福身上多处伤势,与坠楼姿势可判断赵明福从高处坠下前后,还是清醒。

他週三在反贪委会代表律师拿督阿都拉萨引导下,针对赵明福坠楼时是否清醒作出进一步解释。

他强调,如果赵明福是已死亡或失去意识情况下,被人从14楼推下,他身上蒙受的伤势、伤势形状,都会有所不同,而且也不会以脚先著地。

“赵明福身上多处骨折、器官受创、加上严重內出血等伤势,可判断他在坠楼时依然清醒,而且经过解剖,並没有发现遭人掐颈窒息而死或殴打的痕跡。”

同时,他指出,赵明福脚部、臀部遭受的重创,符合坠楼伤势,也进一步证明他坠楼时是以脚先著地。

另外,沙希淡在接受陈福泉的盘问时,也强调赵明福的舌头出现淤血,显示体內有严重內出血的现象,也符合坠落伤势。

解剖时尸体状况良好
首份报告比次份更完整


沙希淡强调,基於首轮解剖时死者尸体状况良好,因此一般上,拥有“第一手”资料的首份解剖报告比起次轮解剖得出的报告,来的更为完整与优异。

他週三下午在阿都拉萨引导下承认,首份解剖报告因尸身“保鲜度”高,报告內容会更优於次轮解剖报告。

虽然赵明福尸体首轮与次轮解剖相距近5个月,但沙希淡指出,基於赵明福下葬时,尸身已进行防腐工作,因此尸体情况尚算完整,可顺利完成解剖工作。

他也解释,在次轮解剖工作进行时,他与另两名本地法医凯鲁阿兹曼与巴拉斯汉都本著要找出真相的態度,相互给予协助,並没有出现爭执的情况,而3人在二度解剖时,也会开会瞭解解剖工作详情。

Beng Hock might have been strangled prior to death

SHAH ALAM, March 1 — Sungai Buloh hospital chief pathologist Dr. Shahidan Md. Noor today agreed with lawyers Gobind Singh Deo and Malik Imtiaz Sarwar that it is possible that that neck injuries sustained by Teoh Beng Hock might have been caused by strangulation.

He, however, affirmed in court that it was not likely that the strangulation killed him and that his fall was the cause of death.

“He (Dr. Shahidan) agreed that the injuries to the front part of the neck might have not been connected to the injuries of the fall. It’s open to argue that it could be a pre-fall injury,” said Malik, who is the lawyer for the Selangor state government.

Teoh, a Selangor government political secretary, was found dead last July 16 at the Malaysian Anti-Corruption Commission (MACC) Selangor office after an overnight interrogation.

Malik explained to reporters that the injuries to the throat muscle could have been caused by choking or strangulation.

He said that there were three main injuries to the neck, and that the cause of the first two injuries were different from the third injury, which affected the spinal area.

“It has now been accepted that the first two injuries to the neck muscles were separate injuries than the deeper muscle.”



Earlier in the coroner’s court, counsel for Teoh’s family Gobind Singh Deo went all out to establish doubt over the findings of the first post-mortem report by Dr Khairul Azman Hj Ibrahim and Dr Prashant Naresh Samberkar.

The fiery lawyer argued that the report was “insufficient” as no tests were done to examine the marks around the neck, something which should have been “standard procedure” in cases of custodial death.

“There was no dissection done on material parts, most important the injuries to the neck. The two important things to look for are not in the first report.

“No dissections were done in the first report as you have conducted in the second post-mortem,” said Gobind.

While Dr. Shahidan agreed that the report lacked details of the investigations the neck abrasions, and concurred with Gobind that it was strange that these marks were not in the first post-mortem report, he stopped short at agreeing with Gobind’s suggestion that the report was insufficient and “utterly incompetent.”

Dr. Shahidan moved to defend the findings of the first report, despite being open to the possibility that it was evidence of strangulation.

“The superficial injuries on the neck would have only been evident after 24 hours, that’s why they couldn’t see the marks. The signs of asphyxia were not apparent on Teoh Beng Hock’s neck,” said the pathologist.

“Does the report reflect dissection was done?” asked Gobind.

Dr. Shahidan says it was done, but not recorded, which led Gobind to accuse him of going out of the way to defend the first report.

At the beginning of the inquest today, the doctor had explained that the signs to look for in cases of custodial death are pressure marks around neck, signs of beating, internal injuries which are not consistent with input given by the officer in charge of the supposed detainee.

“If it weren’t for Dr. Pornthip’s testimony, we would not know about the cause of injuries to the neck of the deceased. Now, there is a possibility that Teoh Beng Hock was strangled on the 14th floor of the MACC. Now I didn’t say strangled to death, I said strangled. These are material facts to be considered in this case.”

“Teoh was actually tortured before fall, there are marks which prove it.”

Shahidan: “It’s possible but not probable.”

Gobind: “I see... then again you wouldn’t say anything bad about the first report would you?”

Dr Shahidan’s agreement of the possibility of strangulation seemingly contradicts his own report which rules out manual strangulation although there was evidence of bruises on and contusions to Teoh’s neck.

Teoh, a Selangor government political secretary, was found dead last July 16 at the Malaysian Anti-Corruption Commission (MACC) Selangor office after an overnight interrogation.

The court has fixed March 10 for the cross-examination of Dr. Shahidan to continue and also to call on Kajang councillor Tan Boon Wah to take the witness stand.

苏淑慧诞男婴‧父名可填赵明福

赵明福的妻子苏淑慧今日(週一,2月22日)早上在峇株巴辖班台医院诞下2.9公斤的男婴,母子平安健康,国民登记局也捎来好消息――赵明福的遗腹子在报生时可以在父亲名字一栏上名正言顺地填上“赵明福”的名字。

国民登记局总监拿督奥威接受《星洲日报》访问时表示,他对赵明福妻子苏淑慧顺利生產,母子平安感到欣慰,並希望这项决定对赵家是一项喜讯。

他说,苏淑慧在生產后可以到国民登记局总部或任何分局为儿子报生,最重要的是她觉得方便就好。

“她要在峇株巴辖国民登记局分局或到布城总部进行报生登记都可以,我会亲自指示峇株巴辖分局的官员协助她登记,这不是问题,请她不用担心。”

他表示希望各方不要再爭议和渲染赵明福孩子的报生纸上是否可填写赵明福名字的课题;当局是以个案方式来处理此事。

赵丽兰:不想让明福孩子曝光

赵明福的妹妹赵丽兰在新闻发佈会上则表示,家人希望明福孩子能平凡健康的成长,所以不想让孩子的模样在媒体上曝光。

赵丽兰表示,淑慧诞下男婴后母子平安,而且也非常感谢大家的关心。

“淑慧目前在亚依淡马华小学执教,所以她会留在巴力拉惹的娘家坐月,等到假期时才会带孩子到马六甲小住。明福的孩子也会在马六甲庆祝满月。”

赵丽兰週一(2月22日)与哥哥铭基及父母亲一同来到峇株巴辖班台医院探望淑慧,过几天姊姊丽君也会到来探望。

Teoh’s ‘wife’ delivers baby boy


KUALA LUMPUR, Feb 22 — Soh Cher Wei (picture), the 28-year-old teacher who was engaged to be married to Teoh Beng Hock, gave birth to a baby boy by Caesarian section, a source close to the family told The Malaysian Insider.

She was earlier taken to the Hospital Batu Pahat at 9am.

“He looks like his mum, got fair skin,” Teoh Lee Lan, younger sister to the late Selangor political aide, told The Malaysian Insider this afternoon.

She declined to disclose the time of birth for privacy and only said he was born in the morning and weighs about 3kg. She added that Soh is not able to leave the hospital just yet.


Lee Lan, 29, said the family had not had a chance to cuddle the newly-born baby who has yet to receive his name.

“We are happy as both of them are healthy and normal...We hope his birth can bring good news got his father’s case, justice for Beng Hock.

“We hope he can bring happiness and hope to his mum and both families,” Lee Lan spoke on behalf of the Sohs and Teohs.

“We hope he can grow up safely and have a normal life,” she said and blessed him with peace and health.

Soh was inducted into the Teoh family according to traditional Chinese rites last October, and was two months pregnant when her fiancé was found dead.

The couple was scheduled to register their marriage last July 17, which was dashed following Teoh’s untimely death.

The 30-year-old political secretary to Selangor executive councillor, Ean Yong Hian Wah, had been questioned overnight by the Malaysian Anti-Corruption Commission (MACC) investigating claims his boss had misused state funds.

His body was found sprawled on a 5th-floor corridor outside the MACC office in Plaza Masalam, Shah Alam the next day. The mysterious circumstances surrounding his death are still being investigated by the coroner’s court.

Pathologist says no evidence Beng Hock was strangled

KUALA LUMPUR, Feb 19 — A government pathologist who performed the second post-mortem on Teoh Beng Hock last November, told the inquest into his death today that the DAP aide died from a fall, and also disputed Dr Porntip Rojanasunan’s conclusion that he had been strangled or had his anus penetrated before he fell.

Sungai Buloh Hospital Pathology Unit head Dr Shahidan Md Noor, also said that he agreed with the findings of the first post-mortem which was carried out by Dr Khairul Azman Hj Ibrahim and Dr Prashant Naresh Samberkar.

“I think that Dr Khairul and Dr Prashant had executed their tasks very well. It is difficult to find a report as good as that. I agree with their opinions,” said Dr Shahidan.

The post-mortem examination report submitted by Hospital Sungai Buloh attributed the cause of death to “multiple injuries due to a fall from height.”

Dr Shahidan informed the coroner’s court that although there was evidence of bruises and contusion on the neck of the deceased, there were no signs of asphyxia or fracture of the thyroid cartilage.

The doctor’s opinion was that the bruises on Teoh’s neck was not a result of manual strangulation.


He disputed the testimony of Dr Porntip, who was brought in last year by the Selangor state government to offer her expertise.

“I disagree with Dr Porntip. When strangulation takes place, the pressure from the hands on the neck would be different, and would be more consistent on the area of the neck,” when questioned by lead counsel for the Attorney-General chambers Tan Hock Chuan on why he disagreed with the Thai pathologist.

The pathologist from Hospital Sungai Buloh also disputed the foreign pathologist’s take on the injuries on Teoh’s anus and thigh area, maintaining that the injuries were a direct result from the fall.

Dr Porntip had testified on Oct 21 last year that the injuries on Teoh’s anus had been caused by an insertion of a foreign object, and that the injury was not consistent with the fall from height.

Similarly, she also suggested that the abrasions on Teoh’s thigh was likely caused by beating using a piece of wood.

“I think that the anal injury was a part of the fall, as the patterns of injury suggest so. If it had happened prior to the fall, the injuries sustained by Teoh Beng Hock would have been different,” said Dr Shahidan.

He stressed that if Teoh had been assaulted the way Dr Porntip had suggested, the anal injuries would have been more severe.

“The abrasions on the thigh does not suggest a beating but it suggests a process that can only be a result of an injury caused by a fall,” he added.

Excerpts of the conclusion of the post-mortem examination report by Dr Shahidan read out as follows:

“The second examination performed showed that the deceased sustained multiple injuries consistent with that of a fall from a certain height. There were also injuries on the neck which most likely were formed or produced by the impact of the fall. The pattern and severity of them were in keeping with the incident of event.”

Lead counsel for the deceased’s family, Gobind Singh Deo then requested for more time to view the notes taken today with regards to Dr Shahidan’s opinion on Dr Porntip’s testimony.

Magistrate Azmil Muntapha Abbas then fixed March 1 for Gobind’s cross-examination of Dr Shahidan.

Besides that, an additional date of March 10 was also fixed should the cross-examination take up more than a day. After the cross-examination is completed, Kajang councillor Tan Boon Hua will be called to testify.

Beng Hock’s family to cite MACC officer for contempt

KUALA LUMPUR, Jan 5 — The family of Teoh Beng Hock will apply today to commit a Malaysian Anti-Corruption Commission (MACC) officer for contempt of court for lodging a police report against Thai pathologist Dr Pornthip Rojanasunand.

Family lawyer Karpal Singh said today in a statement that the application will be made against MACC officer Raub Ghani at the Shah Alam magistrate’s court.

“To our minds this is criminal intimidation and a threat to a witness,” Karpal told reporters after filing the papers in the court here.

He said the court should also direct the AG to take action against the same officer under Section 5 of the Abduction and Criminal Intimidation of Witnesses Act 1947which is punishable with 10 years imprisonment and fine.

On Jan 1 two MACC officers lodged police reports against the “Suara Keadilan” tabloid and pathologist Dr Pornthip over an article which confirmed as murder the death of Selangor political aide Teoh who had been questioned by the MACC.

The officers from the Putrajaya MACC investigation branch, made the reports at the Shah Alam district police headquarters here.

They said in their report that they had read the article in the newspaper, dated Dec 29, 2009 to Jan 5 2010, and found that the article concluded that Teoh, a political aide to a Selangor state executive councillor, had been murdered.


They said in the report that, according to the article, Teoh, who was found dead on the fifth floor of the Plaza Masalam building on July 16 last year, was confirmed to have been murdered based on the second post mortem conducted on the body at the Sungai Buloh Hospital on Nov 22 last year.

The two men claimed the report marred the MACC’s image.

Lawyers for Teoh’s family have slammed the police report lodged against Dr Pornthip, saying it could affect the ongoing inquest investigating his mysterious death.

Gobind Singh Deo and Malik Imtiaz Sarwar, representing his employer, the Selangor government, had reportedly said that the two MACC officers had the right to lodge reports but these must have an adequate foundation.

Gobind said it was absurd for the MACC officers to lodge a report against the forensic expert based on the article that quoted anonymous sources.

He said the police report may affect the ongoing inquest as Dr Pornthip may feel intimidated by the police probe and not turn up for the inquest.

The affidavit signed by Teoh’s elder brother, Meng Kee, was filed at the Shah Alam Magistrate court this afternoon.

Karpal pointed out that Dr Pornthip was a crucial witness and should be allowed to give evidence without fear and added that “no obstacle should be put in her way.”

“I call on the new MACC chief Datuk Abu Kassim Mohamed to ensure his officers abide by the law,” the veteran lawyer said.

He added the case had attracted international attention and the entire Malaysian justice system was under scrutiny.

Meanwhile, lawyer Gobind Singh Deo said he hoped the AG would support their application.

“We have come this far and we don’t need this sort of intimidation,” he told reporters.

He added that the application to cite the MACC officer for contempt would be brought to the attention of the magistrate on Thursday when the inquest is scheduled for a mention for all parties to inform the court whether the second post-mortem report is ready.

Besides the reports lodged against Suara Keadilan and Dr Pornthip, the police are also investigating, for sedition, Penang Chief Minister Lim Guan Eng over his recent remarks that Teoh had been murdered.

Police today also questioned Selangor DAP chief Ean Yong Hian Wah for allegedly intimidating the police to stop harassing party leader Lim over the Teoh case.
