Kit Siang: Inquest into TBH's death should be halted to allow Cabinet to review & widen terms of reference of RCI into causes of TBH's death

The 15-day inquest into Teoh Beng Hock’s unusual death at the MACC headquarters on 16th July 2009 which is to begin on Wednesday, 29th July till August 12 should be halted to allow for the Cabinet to review and widen the terms of reference of the Royal Commission of Inquiry into the causes of Teoh’s death to command public confidence in public institutions and the Prime Minister.

The contention by the Attorney-General Tan Sri Abdul Gani Patail that an inquest by the magistrate under the Criminal Procedure Code (CPC) was the right recourse, as the CPC was a specific legislation that made provision for a death inquiry, and that “holding a similar inquiry by the royal commission would be duplicitous in such instance” is totally unpersuasive and unconvincing.

In the first place, the Attorney-General should brush up his command of the English language. “Duplicitous” is derived from “duplicity” described as “double-dealing, deceitfulness” (Oxford Compact English Dictionary) What Gani intends to say is “duplication”.

Gani referred to Section 2 of the Commissions of Enquiry Act 1950 to buttress his contention claiming that it “clearly makes reference to the inquiry into the conduct and management of government officers and departments or for the public welfare”.

Section 2(1) of Commissions of Enquiry Act 1950 reads:

1) The Yang di-Pertuan Agong may, where it appears to him to be expedient so to do, issue a Commission appointing one or more Commissioners and authorizing the Commissioners to enquire into—

(a) the conduct of any federal officer;

(b) the conduct or management of any department of the public service of Malaysia;

(c) the conduct or management of any public institution which is not solely maintained by State funds; or

(d) any other matter in which an enquiry would, in the opinion of the Yang di-Pertuan Agong, be for the public welfare, not being—

(i) a matter involving any question relating to the Islamic religion or the Malay custom; or

(ii) in relation to Sabah or Sarawak, a matter specified in item 10 of the State List.

There is nothing in Section 2 of the Commissions of Enquiry Act 1950 to bar or prohibit the establishment of a Royal Commission of Inquiry into the series of events in the conduct of MACC officers leading to Teoh’s death, how a healthy, vibrant and idealistic young political activist, who is to register his marriage the following day with a two-month child, making active plans for his marriage just before summoned to MACC, should end up as a corpse after going to the MACC headquarters.

There is nothing “duplicitous” in having a Royal Commission of Inquiry although there may be duplication if an inquest is also held. The solution is for the inquest to be held back until after completion of the Royal Commission of Inquiry into all the circumstances and causes of Teoh’s death.
It is illogical and downright irresponsible to artificially chop the circumstances and causes of Teoh’s death into two parts, one to be investigated by an inquest and another by a Royal Commission of Inquiry – with the Royal Commission of Inquiry dealing with the portion of lesser importance, whether Teoh, who has died, had his human rights violated when the paramount question is how and why he died!

The reasons why the Cabinet should establish a Royal Commission of Inquiry are crushingly decisive, and include:

• A Royal Commission of Inquiry is more likely to command public confidence – depending on its terms of reference and composition – than an inquest;

• An inquest is more limited in scope, tied to police investigations while a Royal Commission of Inquiry has wider-ranging powers to go well beyond the confines of police investigations to probe into the causes of Teoh’s death, which includes the MACC’s interrogation of Teoh;

• An inquest will be conducted by a magistrate, the lowliest cog in the judicial system. After two decades of prolonged national and international crisis of confidence in the independence, impartiality and integrity of the judiciary, particularly in high-profile political cases, Malaysian public have no confidence in High Court, Court of Appeal and Federal Court judges. How can the Cabinet expect public confidence to be vested in a magistrate, who will be even more vulnerable to pressures. In contrast, a Royal Commission is headed either by a former judge or former Chief Justice (like former Chief Judge of Malaya, Justice Anwar heading the Royal Commission of Inquiry into Anwar Ibrahim’s black-eye scandal in 1999 and former Chief Justice, Tun Dzaiddin heading the Royal Commission of Inquiry into the 2005 police nude ear-squat scandal). This is because former judges, former Chief Judge or former Chief Justice are perceived as less vulnerable to improper political pressures.

Furthermore, there are Commonwealth precedents of public inquiries into extraordininary deaths.

In 2004, the Ipperwash Inquiry was established by the Government of Ontario under the Public Inquiries Act. Its mandate was to inquire and report on events surrounding the death of Dudley George, who was shot in 1995 during a protest by First Nations representatives at Ipperwash Provincial Park and later died. The Inquiry was also mandated to make recommendations that would avoid violence in similar circumstances in the future.

Section 329 of the Criminal Procedure Code on “Duty of police officers to investigate death” states:

(1) Every officer in charge of a police station on receiving information -

(a) that a person has committed suicide;

(b) that a person has been killed by another, or by an animal, or by machinery, or by an accident;

(c) that a person has died under circumstances raising a reasonable suspicion that some other person has committed an offence;

(d) that the body of a dead person has been found, and it is not known how he came by his death; or

(e) that a person has died a sudden death,

shall with the least practical delay transmit such information to the officer in charge of the police district.

(2) On receipt of the information the officer in charge of the police district or some other police officer acting under his directions and being either the officer in charge of a police station or a police officer not below the rank of sergeant shall immediately proceed to the place where the body of the deceased person is and there shall make an investigation and draw up report of the apparent cause of death, describing the wounds, fractures, bruises and other marks of injury as may be found on the body, and such marks, objects and circumstances as, in his opinion, may relate to the cause of death or the person, if any, who caused the death, and stating in what manner or by what weapon or instrument, if any, the marks appear to have been inflicted.

Can the Police or Attorney-General explain why Teoh’s death was classified as “sudden death” under Section 329(1)(e) when it should more appropriately be classified under Section 329(1)(d) – “that the body of a dead person has been found, and it is not known how he came by his death”.

This question is pertinent and relevant as it raises the question whether the Police had right from the beginning tried to be protective of MACC instead of getting at “the truth, the whole truth and nothing but the truth” over Teoh’s death?

Yesterday, on behalf of the Teoh family, I had faxed an urgent letter to the Prime Minister, Datuk Seri Najib Razak conveying the family’s request for an urgent meeting with the Prime Minister, as their request for a Royal Commission of Inquiry into Teoh’s death had not been properly conveyed to the Cabinet by the MCA and Gerakan Ministers as well as Najib’s political secretary when they visited the Teoh family during Teoh’s wake.

I had not received any reply from Najib to my earlier fax asking for a meeting with him at the first available time when he returned from overseas on Teoh’s death. May be he had not received my earlier fax.

I hope Najib would set a good example to all Ministers and public servants and give a prompt response to my fax yesterday on behalf of the Teoh family.

银行户口:Public Bank (分行A/c No. 3154 127 533)

Kit Siang: Teoh family rejects Cabinet decision and demands comprehensive RCI into TBH's death

Najib is Malaysia’s David Copperfield – creating the illusion of a Royal Commission of Inquiry into Teoh’s death when there isn’t one

I have come to Alor Gajah for the media conference by the family of Teoh Beng Huat who has just announced that they reject the Cabinet decision yesterday on the mysterious death of Teoh Beng Hock, who went to the MACC Hqrs as a healthy, vigorous and idealistic political worker but ended up as a corpse.

The Prime Minister, Datuk Seri Najib Razak and the Cabinet Ministers seem to be Malaysia’s David Copperfields, creating the illusion of a Royal Commission of Inquiry (RCI) in Teoh’s death when actually there is none.

Like Teoh’s family members, I had at first welcomed the Cabinet decision when there was at first news that it had decided on a RCI on Teoh’s death but when the details of the Cabinet decision became known, we were all dumb-founded, shocked and outraged.

What is the use having two inquiries, with an inquest into Teoh’s death but a Royal Commission of Inquiry strictly prevented from delving into the causes of Teoh death but only to probe into the MACC’s investigative techniques?

I support the Teoh family’s stand to reject the Cabinet decision as it does not represent what is wanted by the family and the people – a RCI into the causes of Teoh’s unusual death.

The Teoh family has called on Najib to respect their wishes and those of the Malaysian public for a comprehensive Royal Commission of Inquiry into Teoh’s death and to alter the Cabinet decision accordingly.

Najib has said that he wants “the truth, the whole truth and nothing but the truth” about the causes of Teoh’s death, and if he serious and sincere, let him accede to the wishes of the Teoh family to have a comprehensive RCI into Teoh’s death.

Najib said he would meet with the Teoh family after the outcome of the inquest into Teoh’s death and the Royal Commission of Inquiry. What is the use of meeting the Teoh family when the damage had been done.

Najib should meet with the Teoh family to hear their wishes for a comprehensive Royal Commission of Inquiry.

I will write to Najib conveying the Teoh family’s request for a meeting with Najib and I am prepared to accompany the Teoh family to a meeting with Najib.

Loke: Decision to Shun RCI in Favour of Inquest an Insult to the Public

The Cabinet’s decision to launch magistrate’s inquest instead of a Royal Commission of Inquiry into Teoh Beng Hock’s mysterious death is an insult to the Malaysian public, and particularly Teoh’s family.

Teoh’s family, colleagues and comrades, as well as members of the public have been calling for a Royal Commission of Inquiry into Teoh’s death to clear all doubts over this case. However, the government has turned a deaf ear to the wishes of the people.

The half-hearted plan to just carry out an inquest into Teoh’s death is simply not the solution to bring about justice to Teoh. It is merely a political solution for Najib to try and limit the outpouring of negative sentiments towards government institutions triggered by the tragedy.

This, together with the setting up of a Royal Commission to probe MACC’s interrogation procedures, is just a public relations exercise designed to somehow please the angry public. But we will not be fooled!

The Cabinet should shelve its plan for a magistrate’s inquest and set up a Royal Commission of Inquiry into Teoh’s death if it is really sincere in finding the truth and helping Teoh’s family.

Kit Siang: Cabinet decision on RCI into TBH's death falls far short of public expectation, unsatisfactory & unacceptable

I am disappointed by the Cabinet decision on the mysterious death of Teoh Beng Hock.

There will be no Royal Commission of Inquiry into the causes of Teoh’s death although an inquest would be held.

A Royal Commission of Inquiry will be set up, but only to look into the Malaysian Anti-Corruption Commission's (MACC) investigative procedures and to determine if there were any human right violations when Teoh Beng Hock was being interrogated.

This falls short of public expectations and is unsatisfactory and unacceptable.

What the Malaysian public want is a Royal Commission of Inquiry into the mysterious causes of Teoh’s death at 14th floor of MACC Hqrs, the investigating procedures of MACC as well as into the independence, professionalism and integrity of the MACC whether it has become the catspaw of its political masters to declare war on the Pakatan Rakyat instead of declaring war on corruption.

MCA, Gerakan, MIC and SUPP Ministers have led the Teoh family and the public “up the garden path” into believing that they support a Royal Commission of Inquiry into Teoh’s death.

Did they press for a RCI into the causes of Teoh’s death and were outvoted by the rest of the Cabinet or had they agreed all along to only have a RCI into the investigative techniques of MACC but not into Teoh’s death.

Let MCA President and Transport Minister Datuk Seri Ong Tee Keat, Gerakan President Tan Sri Koh Tsu Koon and all the other Ministers concerned speak up!

1. 赵明福丧生时,手机不在他的身边;

2. 他在星期四上午8时至9时之间去世;

Kit Siang: Eve Open Letter to PM & Cabinet - Form RCI on Teoh Beng Hock's death

Open Letter to the Prime Minister and the entire Cabinet by DAP Parliamentary Leader and MP for Ipoh Timor Lim Kit Siang 15 hours before tomorrow’s Cabinet meeting

YAB Prime Minister,
YAB Deputy Prime Minister,
YB-YB Ministers.

Form three Royal Commissions of Inquiry, on Teoh Beng Hock’s death, the RM12.5 billion PKFZ scandal and to propose a blueprint to roll back the crime wave of the past five years to create a safe Malaysia

YABs and YBs,

It is seven hours since the Prime Minister, Datuk Seri Najib Razak returned from his overseas trip this morning, closeted with top police officers for half an hour immediately on his touchdown at the Kuala Lumpur International Airport at 11.15 am.

However in the past seven hours, there has been no announcement by Najib of a Royal Commission of Inquiry into the mysterious death of Teoh Beng Hock, 30, the political secretary to Selangor DAP State Exco and State Assemblyman for Seri Kembangan, Ean Yong Han Wah who went to the Malaysian Anti-Corruption Commission (MACC) Shah Alam to co-operate in its investigations but end up as a corpse at the MACC Hqrs last Thursday 16th July 2009.

Malaysians regardless of race or religion are deeply disappointed because the Prime Minister is not prepared to be as decisive as the former Prime Minister, Tun Abdullah Ahmad Badawi who had announced an independent public inquiry into the police nude ear-squat scandal on his touchdown at the Royal Malaysian Air Force (RMAF) base in Subang on Monday, 28th November 2005 on his return from the Commonwealth Heads of Government Meeting (CHOGM) in Malta, well ahead of any Cabinet meeting!

Could it be that the Prime Minister, who is using all the latest Internet gadgets to take the pulse of the people on a 24/7 basis, being the first Malaysian Cabinet Minister and Prime Minister to use the twitter, had not been properly informed of the nation-wide shock, grief, anger and outrage at the unnecessary sacrifice of Teoh in MACC?

Hadn’t the Prime Minister been informed by all the MCA, Gerakan, MIC and even UMNO Ministers – as well as his new political secretary Dr. Oh Ei Sun – that it is not only the MACC and the Police which are on public trial, the very credibility, integrity of legitimacy of his premiership is also on trial?

Fearing this might be the case, I am issuing this Open Letter to the Prime Minister and the entire Cabinet on the eve of your weekly meeting to underline the national importance why there can be no procrastination tomorrow in the establishment of a Royal Commission of Inquiry into Teoh Beng Hock’s mysterious death.

In fact, the Cabinet tomorrow should take the unprecedented and historic decision to form three Royal Commissions of Inquiry, on Teoh Beng Hock’s death, the RM12.5 billion PKFZ scandal and to review the Dzaiddin Police Royal Commission Report and to come out with a blueprint to roll back the crime wave in the past five years and create a safe Malaysia.

The announcement of the latest police findings after completing 60% of their investigations into Teoh’s death have raised even more questions and pressing reasons why a Royal Commission of Inquiry is imperative.

As announced by the Selangor police chief Datuk Khalid Abu Bakar yesterday, police probe so far has revealed:

1. Teoh’s handphone was not with him when he died;

2. He died between 8am and 9am on Thursday;

3. He was believed to have fallen from the 14th floor window.

These police findings can only fuel more questions, as for instance, MACC investigations director Datuk Shukri Abdul had been reported in the media as saying that the handphone had been returned to Teoh. Now, Police said that the handphone had been with the investigating officer when MACC was already done with questioning Teoh, allegedly at 3.45 am on Thursday.

These are among a ton of other questions that can only be satisfactorily answered by a Royal Commission of Inquiry, formed in consultation with Pakatan Rakyat leaders with regard to its terms of reference and composition.

The Royal Commission of Inquiry should not be confined to investigate into the death of Teoh but be a wide-ranging remit for a total review of MACC’s investigation procedures and its ability to maintain its independence, professionalism and integrity from political interference.

In a wide-ranging interview with Sin Chew Daily last Thursday and a Sunday speech, MCA President and Transport Minister had made the most serious allegations ever about high-level corruption and abuses of power reaching all the way to the Cabinet, causing him to allege that corruption had emerged from the “darkness” into the open to do their evil work.

Why had both the MACC and Cabinet closed their eyes and ears to pretend Ong had never made such serious allegations of worsening corruption in the country, reaching all the way to the Cabinet?

The time has also come for the Cabinet to form two Royal Commissions of Inquiry , one into the RM12.5 billion Port Klang Free Zone scandal, and the second, to roll back the tide of crime in the past five years by reviewing the 2005 Dzaiddin Police Royal Commission Report and to work out a blueprint to create a Malaysian police force which is efficient, incorruptible, professional and world-class committed to the three core functions to keep crime low, eradicate corruption and protect human rights of Malaysians.

All Malaysians are waiting for the Prime Minister and the Cabinet to do what is right for the country and future generations by giving real meaning to the new administration’s motto of “1Malaysia. People First. Performance Now”.

Don’t disappoint Malaysians.

For “1Malaysia. People First. Performance Now”?

Pemuda PR: Penubuhan Suruhanjaya Diraja utk Menyiasat Kematian Teoh Beng Hock

21 Julai 2009

Y.A.B. DATO’ SERI MOHD. NAJIB BIN TUN HAJI ABDUL RAZAK
Perdana Menteri Malaysia
Pejabat Perdana Menteri,
Blok Utama, Bangunan Perdana Putra,
Pusat Pentadbiran Kerajaan Persekutuan,
62502 PUTRAJAYA.

YAB Dato’ Seri,

Sekian. Terima kasih.

Police Violence at the Peaceful Assembly over the Mystery Death of Teoh Beng Hock at MACC Selangor

MEMORANDUM TO HUMAN RIGHTS COMMISSION OF MALAYSIA (SUHAKAM)

21 JULY 2009

POLICE VIOLENCE AT THE PEACEFUL ASSEMBLY OVER THE MYSTERY DEATH OF TEOH BENG HOCK AT MACC, WISMA MASALAM, SHAH ALAM, MALAYSIA

We, the victims of police violence, Rawang State Assemblyperson Gan Pei Nei, Loo Chuan Boon, Ng Yap Hwa and Sarah Devaraj would like to lodge an official complaint to Human Rights Commission of Malaysia (SUHAKAM) in relation to violent attack by the Royal Malaysian Police during a protest over the death of Teoh Beng Hock. This incident was took place on 17th July 2009 about 11am to 12pm, at the headquater of Selangor Malaysia Anti Corruption Commision (MACC), Wisma Masalam, Shah Alam, Malaysia.

Background

On 16 July 2009, Teoh Beng Hock (30 years old), aide to Selangor State Exco Ean Yong Hian Wah, was found death few hours after summoned by the MACC Selangor to assist into an investigation of misuse of State allocations fund.

Seri Kembangan assemblyman Ean Yong Hian Wah was among the seven Pakatan Rakyat (people’s Alliance, Selangor state ruling coalition) state assemblypersons investigated over the allegedly misused of their constituency funds by MACC (a federal agency under the purview of Barisan Nasional).

Teoh was taken to the MACC headquarters for questioning at 5.40pm on 15th July 2009. According to MACC investigation division director Shukri Abdul in a press conference, the interrogation completed at 345pm and Teoh was released immediately.

At around 1.30pm on 16th July 2009, his body was found at the rooftop of a building next to the towering block which houses the MACC headquarters. The death of Teoh is shrouded in mystery and a slew of unanswered questions.

On 17th July 2009, a crowd of 300 people including the opposition leaders, parliamentarians, assemblymen, their assistants and concerned citizens were gathering at Wisma Masalam at 10am to demand an answer from MACC over the mystery death of Teoh.

At 10.40am, the Selangor State Police Chief Khalid Abu Bakar had given instruction to disperse the crowd. About 20 policemen in uniform, plain cloth and Federal Reserve Unit (FRU) barged into protesters and violently arrested several parliamentarian, state assemblymen and their aides.

We strongly condemn the act of Royal Malaysian Police, this incident of police violence is clearly a blatant disregard to the fundamentals of human rights in Malaysia as enshrined in Federal Constitution, which has guaranteed people’s freedom of expression and right to peaceful assembly. The Barisan Nasional government had abused of government machineries to oppress the political opponents.

We deeply regret that the government has not political will to bring reform into the police force, neither it implements the 125 recommendations by the Royal Commission in 2004. More importantly, this incident of police violence illustrates the abuse of power and misconduct of the police force had already reached a critical level.

Furthermore, the UN Code of Conduct for Law Enforcement Officials spells out in Article 5 that no law enforcement official may inflict, instigate or tolerate any act of torture or other cruel, inhuman or degrading treatment or punishment or invoke superior orders or exceptional circumstances, such as a threat to national security, to justify these actions.

We are also of concern over the continued arbitrary denial of right to assembly which is articulated in the Police Act 1967 Section 28. We demand the government to abolish the section immediately and unconditionly, this is unacceptable for a member state of United Nations which endorsed the Universal Declaration of Human Rights and sit on the Human Rights Council of United Nations.

Below are descriptions how the victim were handled by the police:

1) Rawang State Assemblyperson Gan Pei Nei

When police dispersing the crowd, Gan was pulled out from the crowd violently by several male and plain cloth policemen. While some of the protesters tried to rescue her, the plain cloth policemen push her to the ground and her head was hitted on the ground.

It is no doubt that the male policemen had used excessive force on a female protester, this is also tantamount to sexual harrassment to an elected representative.

She then had received medical treatment at Hospital Tengku Ampuan Rahima, Klang.

2) Loo Chuan Boon

Loo, aide of Selangor executive councillor and Bukit Lanjan State Assemblyperson Elizabeth Wong Keat Ping.

He was beaten by police several times and was pushed and fell on the floor. Then, a policeman stepped on his waist, manhandled and handcuffed him. He was also dragged by the police for about 30 metres as he refused to walk and sat on the ground then. At last, he fainted while he was dragging along the road.

There are bruises found on his hand and legs. He then was sent to hospital Tengku Ampuan Rahima , Klang together with YB Gan Pei Nei for medical treatment.

3) Ng Yap Hwa

Ng, aide of Klang member of parliament Chales Santiago.

He was manhandled by policemen in uniform and plain cloth while he tried to protect Loo Chuan Boon from arresting by police. Police were grabbing and dragging him along the road for about 50 metres.

Scratches were found on his left hand and left leg, his shirt, pant and beg were damaged during the manhandling.

4) Sarah Vanitha Devaraj

Sarah, aide of Klang member of parliament Chales Santiago.

She was kicked and pushed by male police while rescuing Ng Yap Hwa from arresting by police.

The action by those male policemen is tantamount to sexual harrassment to a female.

We, in light of these incidences, urge SUHAKAM to:

1. Conduct an independent inquiry on the above abuses and human rights violations. This is pursuant to Part III of Human Rights Commission of Malaysia Act.

(12. (1) The Commission may, on its own motion or on a complaint made to it by an aggrieved person or group of persons or a person acting on behalf of an aggrieved person or a group of persons, inquire into allegation of the infringement of the human rights of such person or group of persons.)

2. To ensure the police and the authorities respect and protect the Constitutional Rights enshrined in the Federal Constitution.

3. To play an active role in monitoring and intervene in future events of peaceful assemblies and mediate with the police on our fundamental rights at the first point of violation.

4. To pressure government to repeal all discriminative laws that. restrict freedom of expressions and freedom of assembly in Malaysia.

5. To put more pressure on the Premier in order to set up the Independent Police Complaints and Misconduct Commission (IPCMC) immediately to curb the police violence.

Lastly, we welcome the statement by SUHAKAM that it would carry out an independent investigation into the death of Teoh Beng Hock and might consider to hold a public inquiry. We sincerely hope that SUHAKAM implements its words in the governmental system, “Human Rights standards must be maintained and practised during investigations and interrogations by the MACC and all other enforcement agencies”.

DAP: RCI into TBH's death - Immediacy, Neutrality and Entirety

With regard to the Deputy Prime Minister Tan Sri Muhyiddin Yassin’s statement that a cabinet meeting will he held on Wednesday to discuss whether to establish a Royal Commission of Inquiry (RCI) to investigate Teoh Beng Hock’s death, Democratic Action Party insist that they not only do that, but DAP also stresses that the RCI that is established must include the following traits: immediacy, neutrality and entirety, in order to reveal the truth for the sake of Beng Hock and his family.

Immediacy: Teoh Beng Hock will undergo his burial ceremony soon. Precious time for investigation purposes is fading. By coincident, this coming Wednesday is the “seventh day” of Beng Hock’s passing. The Barisan National government should announce the establishment of the Royal Commission on that day at the very least, in order to bring some comfort to Beng Hock’s family and relatives on the “seventh day” of his passing.

Neutrality: At least half of the Royal Commission’s members should be recommended and appointed by Pakatan Rakyat. Teoh Beng Hock was a DAP member, as well as a member of the Selangor PR government. Thus it is logical and appropriate for PR to have the right to recommend and appoint half of the members of RCI. Only by doing this, then will the public believe that the RCI is independent, non-partisan and credible.

Entirety: Other than investigating the cause of death of Teoh Beng Hock, the Terms of Reference must include a total re-evaluation of Malaysian Anti-Corruption Commission’s (MACC) power and standard operating procedures (SOP). MACC should not be allowed to collect evidence by threatening the witnesses nor interrogate witnesses after 7.30 p.m. MACC must undergo a total reformation, in order to ensure that MACC is not a tool of BN government and use to intimidate and control the people.

The establishment of the RCI is only the first step towards revealing the truth of Teoh Beng Hock’s tragic death. DAP will scrutinise the establishment of the RCI ensure that it maintains its consistency in its performance and responsibility, so that similar incident will not be repeated.

Letter: Meminta satu perjumpaan dengan YAB segera

Kit Siang: Najib has no option but for RCI into TBH’s unusual death, for the sake of the credibility of MACC and his premiership

I will ask Anwar and Hadi to come along to impress on Najib why for the sake of the credibility of MACC and his premiership, there is no option but for a Royal Commission of Inquiry into Teoh Beng Hock’s unusual death from plunge from 14th floor of MACC hqrs

Yesterday morning, I sent an urgent fax to the Prime Minister, Datuk Seri Najib Razak asking for a meeting at the first available opportunity on his return from overseas over the unusual plunge to death of Teoh Beng Hock, political secretary to DAP Selangor State Exco and Seri Kembangan Assemblyman, Ean Yong Hian Wah from the 11th floor of Malaysian Anti-Corruption Commission (MACC) on Thursday.

Letter: Meminta satu perjumpaan dengan YAB segera

I made clear in my fax that the purpose of the meeting is to discuss Teoh’s unusual death in MACC custody which has created nation-wide anger and outrage from Malaysians regardless of race, religion or political affiliation apart from a handful of top MCA, Gerakan, MIC and UMNO leaders.

If I meet Najib on his return from overseas, I will impress on him that the MACC after six months of creation is on trial, the police is on trial and most important of all, Najib’s premiership is on trial in their handling of Teoh’s unusual death and public anger as to how a healthy, vibrant and idealistic young political worker could enter the MACC hqrs as a witness in its investigation only to end up as a corpse in a plunge from the 14th floor of the building.

I am prepared to meet Najib even at the Kuala Lumpur International Airport (KLIA) when he returns from abroad tomorrow.

If Najib agrees to meet, I will ask the Parliamentary Opposition Leader and Parti Keadilan Rakyat Malaysia Ketua Umum Datuk Seri Anwar Ibrahim and the PAS President, Datuk Seri Hadi Awang to come along to impress on Najib why for the sake of the credibility of MACC and his premiership, there is no option but for a Royal Commission of Inquiry into Teoh Beng Hock’s unusual death from plunge from 14th floor of MACC hqrs.

Public confidence in the Cabinet is not enhanced by the schizophrenic and self-serving reactions given by Ministers to Teoh Beng Hock’s death.

I was impressed yesterday that the Deputy Prime Minister, Tan Sri Muhyiddin Yassin was moving away from his earlier dismissal of calls for a Royal Commission of Inquiry into Teoh Beng Hock’s death when he said yesterday that requests for a Royal Commission of Inquiry would be discussed in the next Cabinet meeting on Wednesday.

But what is most disappointing are the public positions taken by two Cabinet Ministers, one by the Home Minister Datuk Seri Hishammuddin Hussein and the other by the MCA President and Transport Minister, Datuk Seri Ong Tee Keat.

After keeping a thunderous silence on Thursday and Friday, Ong has come out with a wishy-washy position that the Cabinet will “explore” whether there should be a Royal Commission of Inquiry into Teoh’s death.

What is there to “explore”? What the public want is that Ong and the three other MCA Ministers, as well as Gerakan President, Tan Sri Koh Tsu Koon should take a firm stand in Cabinet that a Royal Commission of Inquiry into Teoh’s death should be set up – and that there is no two ways about it.

If on Teoh’s death, Ong and his team of four MCA Ministers and Koh cannot convince the Cabinet to set up a Royal Commission of Inquiry, what is the use of their remaining in the Cabinet?

Such a firm and uncompromising stand must be taken after the shocking statement by Hishammuddin yesterday, who said that the establishment of a royal commission to investigate Teoh’s death should not be done hastily as police investigation into the case was still at the preliminary stage.

Are the MCA and Gerakan Ministers prepared to speak the truth in the Cabinet on Wednesday and convey the total lack of confidence of Malaysians from all racial and religious groups in any political investigation into high-profile cases of deaths in custody – after the outrageous case of Anwar’s “black-eye” scandal while in police custody in 1998, when the police accused Anwar of “self-inflicted” “black-eye” wounds?

Muhyiddin was misleading the public when he said that only the Cabinet can decide on whether there could be public independent inquiry into Teoh’s death.

The Prime Minister has the power to make such a decision and make an announcement even before a Cabinet meeting – which was what former Prime Minister, Datuk Seri Abdullah Ahmad Badawi did on Monday, 28th November 2005 on touch-down at the Royal Malaysian Air Force (RMAF) base in Subang when he returned from the Commonwealth Heads of Government Meeting (CHOGM) in Malta, announcing an independent public inquiry into the nude ear-squat police scandal ahead of any Cabinet meeting!

Is Najib going to be even less decisive than his predecessor, Abdullah on the need for an independent public inquiry into scandals involving key enforcement agencies like the Police or MACC, which go to the root of public confidence in the credibility, legitimacy and integrity of the entire administration and his premiership?
